I'd say you are in a position of great leverage and power, and just might get whatever machine you want if you are willing to continue to do business with them. Presentation will be key. Go to them with the facts.
Your company's intentional deceptive business practices include the following:
1. Misrepresentation of which products are covered by insurance, with the intent to deceive and supply a substandard product.
2. Dispensing of a discontinued item.
3. Dispensing of a used item.
Maybe they operated within the law, I don't know, but they certainly didn't operate in the customer's best interest or honestly.
If you do want to try to get a better machine out of them, just state your facts then say, "Your turn." Or give them a piece of your mind, and leave them with the machine. I wish I could remember the caution I've read here, but maybe someone else can chime in on this. Be careful to not sign anything that they can use to call you non-compliant with treatment. Anyone know what I'm talking about?
And I'm curious if they are charging your insurance as if it were a new and current machine. Does anyone know if the machine was previously dispensed if the warranty started at that time or how warranties work? Hopefully you'll see fit to report them to your insurance and any governing agencies.
