I personally would not in a million years. The question is, how much freedom should we allow other people to make bad choices?

Shockingly (pun intended) you can - maybe not from Walmart but from Amazon!:

No, that is not the question. The question is why does one person or one group of people or a majority of people think they have the right to tell other people what choices to make.

A secondary question is who is wise enough to be granted the power to decide what other people should do.

No the question is whether you want to be conned into buying cheap and shoddy goods for a high price that have not met any real standards of quality. Will you need a phd in medical technology before you can safely and confidently buy medical equipment?

YOU CAN NOT MAKE A "GOOD CHOICE" IF DON'T HAVE ANY GUIDES TO MAKE ONE!
You cannot have an industry "monitor" themselves. We tried that in Canada and 50 people died a horrible death fried in oil. The meat industry now has issue after issue with ecoli. If someone can get away with selling cheap shoddy goods and running with the money they will do it.

People who have studied the industry, have phd's in the area are far more qualified to judge then some desperate person looking for a quick and cheap fix to their health issues.

I am sure I would have been better off if I had gotton my defib from Wal Mart, as mine was installed without using enough novicane, until I passed out from the pain, and they installed it with a defective lead wires.

At least Wal Mart would have had a lowest price option, replacing the battery could be done in the watch dept. Jim

There are probably a lot of companies that could make a machine that would work as well as the big name companies. Sleepy Head beats the name brand software in my opinion. It wouldn't be any threat to me to see OTC cpap machines. I wouldn't have to buy one if I didn't want one. It is strange to me why this isn't already an option.

I don't own a gun but I carry a stun gun. It makes me feel better to have it. I am glad it is legal here to have one.

As far as I know, there are no laws prohibiting people from purchasing medical devices without providing a prescription, There are only laws prohibiting the sale of certain medical devices without receiving a prescription. This is a distinction with a difference.

So I really don't think this issue should be confused with arguments about "Life, liberty and the pursuit of happiness" under the Constitution. Rather, it is about the right given by the Constitution to Congress to regulate interstate commerce. In addition, intrastate commerce may, under the US Constitution be regulated by the individual states.

This is a distinction with a difference.
Only you would find that distinction. A law prohibiting someone from selling something to me has the same practical effect (or impractical from my POV) as a law prohibiting me from buying it.

I am sorry friends, but I shop at Walmart almost weekly and am fully capable of judging the quality and price of the products I want to purchase. I know when to purchase and when to go elsewhere. And I act accordingly.

Besides they have an easy return policy. Only once or twice have I returned something. The first time I was going in to a long explanation. The clerk looked up and said, "Ma'am, I just need something short to write in the space." I told him to write, "Didn't like." That did it.

Sears already sells masks, machines and supplies on line. No prescription required.

You can do that at Walmart - we shop there too.

But you can't pick and choose what you like in the Constitution, and ignore the rest.

Shopping the U S Constitution for one's favorite parts, and ignoring the remainder, is the biggest ideological problem we have in the USA today.

Best wishes, Nate

But you can't pick and choose what you like in the Constitution, and ignore the rest.
But you keep voting for Republicans and Democrats who ignore Article 1, Section 8 and act as if the Commerce Clause gives them power to write any legislation covering any point.

Mob rule.

I would like to see just a simple poll on whether cpap should be OTC. That would be interesting.
