From the article - “if a sleep study confirms apnea on active duty, or the condition can be linked back to time in service, and a CPAP (continuous positive airway pressure) machine is prescribed, then the current VA rating schedule requires a 50 percent disability rating.”
In my case (severe sleep apnea with extreme hypoxia) I found that I was only able to work half time effectively and that my earning power dropped by a factor of more than four.

Which would you rather have. A person can run fast and do many chin ups or one whose brain is sharp as a tack.
It is the excessive daytime sleepiness, working memory problems, lack of problem solving abilities, inability to suppress the first response, lack of focus, lack of affect, and inability to maintain vigilance that make the person unable to get the job done. While a person with Obstructive Sleep Apnea may be able to start the day with all of the above they will likely leave him sometime during the day. Since the ability to self monitor is also affected it will likely be his supervisor who notes that he is in trouble.
My experience is that CPAP treatment reduced but did not solve any of the above.

Well we know that at least half of them will not be able to use CPAP for more than four hours a night at the one year mark.
And I know that even with treatment you will not be back anywhere near to 100%.
I think that the 50% disability is probably conservative.

50% is really not 50% either. VA math is jacked up. If a vet has 5 conditions rated at 50, 20, 10, 10, and 10% you would assume that would make them 100%. But, the VA says no.
50+20=60
60+10=64
64+10=67.6
67.6+10=70.84
The VA would rate the vet at 70%
So if a vet was rated for anything that was the same or higher then the 50% from apnea, it would significantly drop it or even eliminate it. I really wish people would not read some persons opinionated article and take it as gospel without knowing facts or at least ow the system works.

Second - how is sleep apnea 'service related'??? This statement makes no sense to me. I think everyone here would agree that our OSA was NOT caused by our employment.

That is the difference between a desk job and military service. You are not crawling through deserts/swamps, getting shot at, blown up and exposed to dangerous chemicals all at the same time - any physical or mental degradation during that time should be considered service related.jencat824 wrote:First - I like the avatar!
