It seems like it'd be a lot simpler, all the way around, if they'd just charge less.

What is the difference in ResMed giving sleep labs testing equipment and masks at reduced prices or free and drug manufacturers giving doctors free samples, meals, etc. in order to get them to use a certain medicine over another. Wait, big pharma has a large congressional lobbying group. Evidently the sleep apnea treatment people haven't spent enough on high powered lobby personnel. :lol: :lol:

Pfizer was fined $2.3 billion under the same statute.
It's all a bit like giving money to a politician...as some point it changes from legal campaign contribution into a bribe. The line isn't particularly black and white.

And the companies have teams of full-time sharks working to get them the best deal--
bribe, fine, or lobbyist swag: it's all part of doing business.
Regulations are little more than an ILLUSION, meant to keep the wheels from squeaking too loudly.

The Anti-Kickback Statute prohibits the knowing and willful payment of any remuneration to induce the referral of services or items that are paid for by a federal healthcare program, such as Medicare, Medicaid or TRICARE. Claims submitted to these programs in violation of the Anti-Kickback Statute are also false claims under the False Claims Act.

Also, Philips Respironics paid out $34.8 million in 2016 to settle a whistleblower lawsuit and DOJ investigation that alleged the company provided its resupply program for free to HME providers that bought its products.
