PadACheek banned from eBay?

Got a email from eBay today:
eBay wrote:Please be aware that the following fixed price listing:

Item Number - 5630992450
Item Title - PAD A CHEEK = CPAP Sleep Apnea Mask Strap Pads

has been removed by eBay for violating of one or more of our policies. Any offers or bids placed on this fixed price listing are now null and void. We advise you not to finalize this transaction with the seller. As stated in the eBay User Agreement, neither seller nor buyer should engage in transactions that violate the law or eBay policy.

I'm sure that the words "CPAP Sleep Apnea" put it in their category of "medical devices" and that's why they pulled it.

Since I spoke with Karen this morning, I know the answer.

She had been cleared via a letter from eBay to advertise on their site. However, she feels that this was probably done by computer; and when the computer picks up anything with the letters "CPAP" in the ad's title, it pulls the ad off the site since eBay does not allow their sellers to sell anything that needs a prescription, such as CPAP machines.

She is taking care of it. In the meanwhile, I would PM her on this site if you want to place an order for the Pad A Cheeks. I'm sure she'd take care of it for you, the lovely woman that she is.

Yes I too received the message this mornign that eBay has taken my sale off their site.
The message they sent to me stated :

SO that is it in a nut shell. Funny thing is I got pre-aproval before I ever placed my product on eBay, and received an email to that effect as well.
Guess they didn't see that. I am in the process of waiting for eBay to get back with me on this one. I did nothing wrong.

Stupid eBay.

I ordered a couple from Karen last week and tried one last night. It does make a positive difference. I had considerably less "strap beard" in the morning and the mask was a lot more comfy overall. That it's red and orange with leopard spots is a bonus.

PADACHEEK,

eBay's right hand often does not know what it's left hand is doing. HOW RIDICULOUS! I guess you would not be able to sell a power strip if it was intended to be used to plug in a cpap. I think that there is more to the eBay cpap ban than they are stating. My guess is that the DME industry has "gotten to them" and convinced eBay to stay out of their territory. The Mafia is alive and well! ...just operating in a different business.

They also took the other guy's strap covers off also, and the cpap tubewrap that I purchased for my hoses seems to be gone also. It also said the buyer could be in trouble for completing the transaction. What if it is already paid for? Can they really go after a buyer for not knowing?

I wouldn't give it two seconds' thought. Could you imagine reading that story in the papers? "Woman Arrested and Prosecuted for Purchasing Pad A Cheeks Via eBay"???

eBay's policies are ambiguous. They say they won't carry sales of new or used cpap equipment as it violates the law.

But they sell a lot of other *equally* restricted medical equipment.

I think there is a probability that eBay are acting under pressure - my guess is that if true the pressure will be coming from the xPAP mfgrs - I know for a fact that ResMed has changed the names of their xPAP models in Australia & USA just to block the flow back of machines into Australia from dealers in the US.

They had been discussing changing the colours of them to identify the country they were exported too. This info came to me from a highly reliable source who deals with ResMed directly.

So, I think eBay will sell anything to anyone given the chance but under duress they will allow lobby groups to police the sales & report back to them violations that they then 'act' on.

btw- I saw a cpap advertised on ebay and sent a question to the seller to reply if it was removed.
