Every state has their own statues. Every state has a State Insurance Commission. Statutes differ by state.

As a successful CPAP user, my condition actually better than most light to moderate sleep apnea suffers who don't use the device. With the reading around 0 - 0.3ish, heck I don't even have apnea any more.
Now it is the matter of compliance. If I can proof to the insurance company and it believe me, I SHOULD get a discount, wouldn't it be fair

Who said the insurance company needs to be fair????? Even if you are compliant today they have no way of knowing whether you will be compliant in the future. They are assuming that you will not be.
