did i miss what item was ordered? All I saw was a humidifier. This is what i think ( if anybody cares) If the website was wrong and the customer didnt use the humidifier...ie.. put water in it. Then they should get a full refund. If the website was right and the customer ordered the wrong one then 50% is a bargain.
I have been ripped off from internet sites, you order something that doesnt work, and they charge you a restocking fee, when the restocking fee wasnt mentions during the intial sale. I love this and the CC company didnt defend me ( ex cc company) I told them that I could sell people rocks and when they return it they have to pay a restocking fee. they didnt want to hear it. :::::::::Stepping off my soap box :::::::::::::

Next time I order ANYTHING from ANYBODY I will ask 10,000 questions before I spend a dime.
Seems like there are only two people who see the nature of my beef.
Since my particular model wasn't specifically excluded from the compatibility list, I assumed it was compatible.
I did buy the wrong piece of equipment.
I still contend however since the merchant claimed compatibility with a series of machines, it is his responsibility to include exclusions, or make known that only some models of the family are compatible.
Had he stated........."This humidifier is compatable with most of the REMstar family", I would have had a heads up to inquire further.
I based my decision to buy this unit on "Works with the NEW REMstar family" and the tiny picture of a machine that looked remarkably similar to the unit I own.
Any legal professional have a take on my argument, that the vendors description was misleading, and should be acountable for not supplying exclusions, when he provided inclusions?

Once the item was opened it became subject to those rules & regs (blame FDA).
The offer of 50% refund is very generous in that they offered to allow the buyer to keep the item & there is an excellent chance of recovering the other 50% via cpapauction or elsewhere.
The H2 humidifier was designed to work with a range of cpaps & bilevels & not just Respironics gear. I have an H2 myself that I purchased for just such use (to attach to a PB330 Knightstar bilevel). It will work with any cpap if the user fits a short (12" hose) freely available from any cpap outlet.
I empathise with the original poster but on health related products the sellers can't wear a 100% loss because of a mistake (although, I am satisfied the H2 can be used with just about any cpap machine if set up with the 12" hose extension).

I'm not a legal professional, but as someone who went to business school (which included courses on business law), I would say that yes you have a case, but they would have decent defense arguments as well. Your case would be *much* stronger if you had actually called them and described your equipment to them, but I think in that case you would have got the correct humidifier. I think they are offering you a good deal with the 50% return. How much would it cost you to take them to court? Because that would be the only other way to settle it. I do see your point about the description, though. I am getting a chuckle out of a medical equipment manufacturer making an analogy of CPAP machines to Mustangs. In a letter to a complaining consumer! Quite unprofessional.I am sorry for the confusion you have encountered regarding your CPAP and humidifier. The “Remstar” brand has been used since the Mid 1990’s and there have been multiple releases and varieties of CPAPs and humidifiers. Just like Ford Motor Company releases different Mustangs from year to year. The representation of these products by an Internet Dealer is solely the responsibility of that dealer.

This product page has existed for years on CPAP.com and has generated thousands of orders without issue. I believe our description was adequate, however, it was not perfectly and inescapably clear. We're the retailer and you're the customer. We create product pages with crystal clear descriptions and (if we're lucky) you buy from us. This is our fault and I apologize. To correct this situation:

But - if these doggone manufacturers would QUIT re-cycling their darn series and model names ad infinitim a lot of confusion could be avoided, i.e. how many Plus models? Pro and Pro II? S8 Elite? S8 II Elite?, etc. etc.

Hey, Jules, if these xPAPs didn't come w/a Quick SetUp Guide most of those local DME supplier RTs wouldn't be able to set the devices up at all, not even the Default settings!!! Those Default settings HAD to have been developed specifically for local DME suppliers' RTs!

I DO work in retail, and am amazed at the number of people that work the system. You didnt do enough legwork to make sure you purchased the right humidifier, and now your blaming someone else. You had your hissy fit and got what you wanted.
They have a 800 number readily available, you should have used it.
Johnny is being a great merchant for giving you a full refund.
