A Sept. 24 hearing is set for a 44-year-old Gardnerville man accused of breaking a woman’s arm.
Ronald John Smith was charged with domestic battery following his arrest Sept. 5.
The incident allegedly took place at his home on July 27.
Smith denied the allegation and told investigators the woman probably hurt her arm when she fell walking up a flight of stairs on July 25. He said she fabricated the story that he struck her.
Deputies were called to Carson Valley Medical Center shortly before midnight on July 27 where the 55-year-old woman was being treated for a broken left arm.
She claimed she awoke Smith and he became enraged. She said he grabbed a breathing mask from his sleep apnea machine, threw it at her, then punched, kicked and choked her.
She said he broke her arm when he knocked her off a stool as she was trying to turn on a light.
According to the victim, Smith threatened to kill her and bury her body on Leviathan Mine Road.
She said before she left the residence, he forced her to write a note swearing that he didn’t hurt her.

Sad story. But, rooster, your comments had me rolling!

Things should improve for RJ when the warden's guards wake him up by means of the cell-block buzzer every morning. (Hopefully they'll let him wash his hose and mask before he has to line up for roll call.) His apparent special-forces training should serve him well there.

Right after I got married, my wife decided to wake me up by "kissing me awake." It must have seemed like a romantic idea at the time. She only tried that once, though. I woke up to find myself with my hands around her throat. If she wakes me up now, it's with a gentle nudge from a few feet away.

All that is off the record, deep background, of course.

I was wondering if she wrote the note with the same hand/arm combination that she supposedly broke going UP the stairs.

Actually, I could understand that under the wrong set of circumstances how a person could become enraged at a person waking them up. All it would take is a person with a mouth that you'd want to silence. (aka "nag", "witch", "jerk"......not referring to a specific gender)

I vote "not guilty".

Inarcerated?
Using CPAP?
In Ontario with 2 years less a day in Maplehurst Correctional you can request segregation-i.e.SOLITARY CONFINEMENT. due to CPAP use.
If that gets you down,look forward to a transfer,CPAP and all, to Central North Correctional Center in Penatanguishine which includes this:

Thankfully in Canada, our insanity plea means that if you are found mentally incompetent to stand trial, you get to spend time in a psych ward until you are able to stand trial. If you are found to have been insane, you go into the mental ward and stay there.
We don't have an insanity plea where you get off of the charges. ONE way or another you are incarcerated.
Ontario's big one for Criminally insane is up near Penatanguishine, a few hours north of my area.
The nurses are actually considered correctional officers as well.

Does anyone on here have first hand knowledge of CPAP and American incarceration?

Positive to see only page one of one,as far as actual prison experience goes,I guess this is not the place...prisontalk.com is.Any coincidence on the forum design being the same over there?

I personally found your input just as relevant and on-topic as 99% of the posts around here. If there's not much discussion about a valid CPAP-related topic I have been known to link threads to make the information easier for others to search down the road... Hence my reason for inserting that other link in this thread.

I could understand that, too, no matter if I was awakened by it or already awake. What we do about the rage is what counts. Just to clarify.......

Are you saying your vote is he's not guilty because you think she was lying?
or.....
Are you saying your vote is he's not guilty because his rage and reaction were understandable and therefore justifiable?

You DID mean the first one, right, Den? I'm 99 44/100ths sure you did and am offering my opinion to the forum in general; not directing this at you:

Unless it's for self-protection or a PTSD flashback reaction (which should be dealt with, not just excused or ignored), nothing justifies one person's throwing things at, punching, kicking, choking or other violent behavior toward another, no matter what gender (women can be just as violent).

Agreed! I was just commenting that I could "understand"......under some circumstances.......not that I'd "condone" any violence.

In far too many stories like this, there are "his side", "her side" and "the truth".

To the contrary, I would say the correlation is highly gender specific.

Cpap or no cpap, if a person of my same gender ever wakes me with a kiss, violence will ensue.

I apologized for weeks. Now, every few years or so, I'll say good night to her then ask: "Would you mind waking me up in the morning with a kiss?" Then we'll both giggle ourselves to sleep.

Oh, and thanks for watching out for Den's reputation like that. You are right that passing visitors might have misinterpreted his words. Good thing we all know what a nice guy he is!

Heh, heh. Yeah, I gotta agree......if I was awakened by a kiss from someone of the same gender, that would definitely be a "soul-searching" moment for me.
However, my statement about not wanting to refer to a specific gender was because I have known people of BOTH genders who could be capable of provoking such a response.
