Advice needed again

Post by FLIGHTYONE » Wed Nov 14, 2007 6:01 pm

a couple weeks ago I told everyone here that my job has offered me a new position that is not as stressful and they are willing to work with me on better hours so I can get enough sleep,
well I went to the new store and it is pure hell, they are making me work my old hours 6 am to 2 pm and I am an extra hour away so I have to get up at 3am , when I told the girl in charge about me being sent here cause of my health she said I have to do this cause she has no one else to do it, so I called the union and they are coming tomorrow to talk to me and the human resourse department,
How should I desribe that I am going thru to make them understand why I need sleep, and not alot of stress, I didnt want people to know that I had a problem but I think I am going to have to tell everyone, I just want my point to be made I need to work a certain hour and get the treatment every night, can someone give me some advice to help me, I have to stay at this job cause it carries our insurance,

I would suggest looking into the Americans With Disabilities law.

you may need to contact HR and ask their procedure - you will probably need to make a written request and get the doctor's letter/form

http://www.jan.wvu.edu/media/accommrequestltr.html

You will probably need your doctor to write a letter which includes answers to this below - you might want to print it out and include your own answers to give to your doctor.

you might also want to search the JAN site about for sleep apnea -

Work and sleep apnea

If you have not already, go up and click on the lightbulb for Our Collective Wisdom then the topic "Work Life and Legislation Concerning Sleep Apnea" to read an informative thread on the subject.

Know the rights and responsibilites of both you and your employer. I wonder about the motives of a company that supposedly transferred you for your benefit yet the conditions and the drive are against your well being. Do you think they are telling the truth now about why they really transferred you?

You seem to be a very conscientious person - please don't let your natural concern for others cause you to forego your rights and what's best for you. (Been there, done that.) You are a conscientious employee, and with cpap treatment will again be more productive. There's nothing wrong with standing up for yourself - you can't be sure an employer has your best interest at heart - it is business. Yes, there's lots of good employers out there who take care of their employees (I had one), I'm just saying to be wise and research any suggestions they make before agreeing to something that may in the long run not be in your best interest.

May everything go well for you as you work through these issues.

Kathy

ADA accommodations are to help you be able to do your work. Notice all the wordage about "reasonable" The workplace gets to decide what reasonable is and only if you fight it with an attorney and and EEOC complaint can that the workplace deems "unreasonable" be possibly overturned.

If the requested accommodations are deemed "unreasonable" and that is the only way you can do your job, you can find yourself without a job.

Another program that you should look at is FMLA - it is time they workplace has to allow you to deal with your own or a family members illness.
