Re: CPAP Class Action Lawsuit Settlement
I haven't heard or seen anything about a settlement I returned their machine years ago and they sent me a replacement and then I was told not to use it Because they hadn't really fixed the problem according to the FDA

Yes, I got a check on the day I made my post. If you have your claim number from your email if you filed online you can call 855-912-3432 to get the status. The representatives can now tell you the status of your claim unlike a year ago when they couldn't tell you anything.Conrad wrote: ↑Fri Feb 06, 2026 8:09 amI've never been paid for the cost of my replacement device, even though I, according to them, qualified for the award. You say that you just received a check? I guess that I had better check the mail today, we have a PO box, and I have to pick up my mail from the post office in town.

Re: CPAP Class Action Lawsuit Settlement
You had to sign up for the class action settlement and the deadline was around 18 months ago. I never heard anything about not using the refurbished Dreamstation they sent me. If you signed up for the recall, and had not moved, you should have received a fairly thick envelope from the claims administrator inviting you to file a claim. They could have paid the claims automatically since they had everyone's address from the recall.

I just now got off the phone with an agent of the Settlement Administrator (insert appropriate echo) and Maryanne told me that they do NOT have access to any account info in regard to the Device Replacement Award. This award will be sent out in the early Spring of 2026, kinda like where we are now, right?reader2580 wrote: ↑Wed Feb 11, 2026 12:21 pmYes, I got a check on the day I made my post. I haven't moved but I didn't pay for it the insurance did so maybe that doesn't entitle me to a settlement.reader2580 wrote: ↑Wed Feb 11, 2026 12:25 pmYou had to sign up for the class action settlement and the deadline was around 18 months ago. Re: CPAP Class Action Lawsuit Settlement
I have been using the refurbished machine! Never heard not to. Been away from all forums for ages. Lots of other health issues I’m dealing with. Did file for claim and get a meager check but still stuck with “fixed” machine that doesn’t work as well as my original one due to age. Now they want me to get a new sleep test. Current pulmonologist doesn’t know how to order new one. Never got a script for changing to auto bipap before old doc left the practice. Humidifier quit so there’s a gap in usage necessitating a new test. Not happy at the moment

Get another doc. Or have this doc call (or send) to whatever Co. you use, they will let him know what the script needs. But me thinks another doc is in order here. He may also want another PSG too.

All I can tell you is my experience. I gave them the number from the email I got when I signed up online for the settlement and they were able to confirm my claim was approved for payment.Conrad wrote: ↑Thu Feb 12, 2026 9:05 amI just now got off the phone with an agent of the Settlement Administrator (insert appropriate echo) and Maryanne told me that they do NOT have access to any account info in regard to the Device Replacement Award. Re: CPAP Class Action Lawsuit Settlement
I got a third payment for my two claims in yesterday's mail. I thought I was all paid up from the class action. Yesterday's payment was for $68. The previous check was for over $700 for device replacement reimbursement.

What is the deal with the refurbished Dreamstations they sent out to replace units like my System One? Are they safe to use? I thought I read something about them having a foam problem too. Should I just throw it out? Hate to waste such an expensive machine, but to say I don't trust Philips is an understatement.

There is no evidence to suspect the refurbs used any problematic foam.tisket wrote: ↑Sun Jun 28, 2026 10:47 amWhat is the deal with the refurbished Dreamstations they sent out to replace units like my System One? During foam-gate the Philips machines were the most scrutinized CPAP devices on the planet, if the replacement foam was problematic you, it would be noted.

Hmm I've read reports like this that make it sound like it's an open issue.

Re: CPAP Class Action Lawsuit Settlement
Two of those links don't even mention foam in replacement devices, the third mentions an unknown source claiming trace amounts, but no mention of levels. Further searching re-enforces there are no trace elements of carcinogenic approaching unsafe levels.tisket wrote: ↑Fri Jul 17, 2026 7:50 amHmm I've read reports like this that make it sound like it's an open issue.

Re: CPAP Class Action Lawsuit Settlement
What?
First link, right in the headline.
"Philips Recalled Breathing Machines in 2021. Chemicals of 'Concern' Found in Replacement Machines Raised New Alarm."
Body
"But as Philips publicly pledged to send out replacements, supervisors inside the company’s headquarters near Pittsburgh were quietly racing to manage a new crisis that threatened the massive recall and posed risks to patients all over again.
Tests by independent laboratories retained by Philips had found that a different foam used by the company — material fitted inside the millions of replacement machines — was also emitting dangerous chemicals, including formaldehyde, a known carcinogen."
Second link, right in the headline
"Concerning Chemicals Found in Replacement Philips CPAP Silicone Abatement Foam"
Body
"Philips Respironics is once more under fire for the handling of its respiratory device recall, this time specifically due to the silicone foam used as a replacement to previous polyester-based polyurethane foam in recalled devices."
From the FDA link:
"Following the initial recall in June 2021, Philips developed a plan to repair the PE-PUR foam in the recalled CPAP and BiPAP devices with a different, silicone-based foam. The FDA initially approved this plan based, in part, on testing the company provided to the FDA in June 2021 on the new foam.
During the manufacturing facility inspection in 2021, the FDA obtained information, not previously available to the agency, regarding the silicone-based foam used in a similar device marketed outside the U.S., which failed one safety test for the release of VOCs. Similar testing provided by Philips to the FDA on devices authorized for marketing in the U.S. had demonstrated acceptable results. The FDA is aware that patients have already received devices with silicone-based foam as part of the repair and replace program.
The FDA requested that Philips retain an independent laboratory to perform additional testing of the silicone-based foam to determine what, if any, potential safety risks are posed to patients by the silicone-based foam."
Was hoping for some more recent info. Philips has been silent since 2024 as far as I can tell.
