Sold My Old ResMed Machine...
So I've had my Resmed AirSense 10 since 2018. Recently got myself a newer machine. The AirSense 10 has been sitting up in my closet gathering dust for about a year now. Figured someone else could benefit from what little life the machine has left in it. However I had a few questions:
* Will my DME know by way of the wireless feature on the Resmed that I sold the machine? I told them I no longer use the machine some time ago.
* Should I tell my DME that I got rid of the machine? Or is that frowned upon?
* The machine was paid off years ago. Is it true that it's okay to sell used machines? I'm worried about getting in trouble with the law.
Yes, I searched the forum. I just wanted to double check everything for peace of mind. Thanks in advance!

No US law covers resale of used home medical devices--AFAIK.
If there were, enforcement would be too expensive.
Secondwindcpap.com has been doing it for years.
You can do it, too.
Some online sale sites do not allow it--but who needs them?

DMEs are notorius for lying and making crap up.
Here's a trick you can use to see if they are being honest.
While they're advising you, carefully watch their mouths. If their mouth is moving when they talk, they're lying to you.

Assuming you actually OWNED the old machine, it's none of their business.
Medicare Advantage plans now set it up so you NEVER own your machine. They are on perpetual rental. If that is the case, you don't own the machine and cannot sell it.
My guess is that you are not on an Advantage plan, as you would still be paying rent on that machine. So you are good to go.

Is the perpetual rental something really recent, a DME thing, or dependent on the Advantage plan itself? Last fall when open enrollment came around I was comparing Medicare supplement and and Advantage plans from my prior employer (Massachusetts). The Advantage plan as best I could tell followed the Medicare 13 month rental which I thought they had to do. I called my DME to verify the machine was paid off. It was paid in full years ago. So that's a relief.

This is an Advantage plan thing, fairly recent. The Advantage plan has the option to do this, Kaiser has opted to do so.Is the perpetual rental something really recent, a DME thing, or dependent on the Advantage plan itself?
It's not necessarily going to show up in their marketing materials during open enrollment. The only place to know for sure is by requesting the "Evidence of Coverage" (EOC) which is the actual contract the insurer has with you, even though you've never seen it unless you know to ask (as one who has taken contract law, I don't understand how they can do this because a contract requires a "meeting of the minds" for an agreement, and if you don't even know there is such thing as an EOC before hand, how can you know what you are agreeing to?).
Another issue is that if it's open enrollment for 2024, will you be able to see the actual EOC for 2024 or the one for 2023 which may be different???
If you contemplate an Advantage plan again in the future, consider that and also that once you are on an Advantage plan it's almost impossible to go back to any traditional Medicare supplement plan.

Isn't that a kicker? Supplemental plans can underwrite you and refuse coverage or charge you more if you switch out of an advantage plan, unless there is a change in circumstances, such as moving away from the service area of the Advantage plan.
