Lawsuit for Undiagnosed Apnea?

Post by Patriot Partner » Sat Aug 10, 2019 5:56 pm

Took 3 years to diagnosis.

Heart, adrenals, pulmanology, allergies, leaky gut, panic attacks

Anybody sued a hospital?

I doubt that you'll get anywhere.

However, we do need to put the medical profession on notice that they can't ignore sleep issues.

I've been on this board for 10 years and cannot remember a new person with more complaints.

Do you have documentation for all of the many times over the years that you must have asked your primary specifically for a sleep test but were denied in writing?

Remember: "Ignorance is nine-tenths of the law." Wait! Or is it: "Possession is bliss"? Or: "A penny taken is a penny earned"? Well, I'm sure there is an appropriate cliche to quote, if I could just remember one properly. I used to know them all before OSA. Or at least I assume I must have.

I googled lawsuit for failure to diagnose sleep apnea and found some interesting reading. Would probably be an uphill battle to hold a provider liable for failure to diagnose unless there was documented undeniable symptomology in the medical records and evidence of related consequence. Certainly understand on a personal level the resentment of having one's life unnecessarily damaged by missed or misdiagnosis.
