Can this be attempted (or even actual) murder?: Burglar makes off with man's sleep apnea machine

Post by D.H. » Tue Mar 19, 2019 9:42 am

Can the theft of critical medical equipment be attempted murder? If the patient should die, can it be actual murder or "felony murder" (murder as the result of a felony)?

Would depend on the jurisdiction.

In many areas, likely to be considered manslaughter rather than murder, unless you could prove the crook knew what the machine was, and intended to cause harm to the victim.

Personally, I find it an interesting question. CPAPs are stolen. And not everyone can get a replacement quickly. What are the legal liabilites for depriving someone of live saving medical equipment? And it also brings up an issue that many here have considered, which is how much back up equipment should one own.

Considering the chance of the police catching the crook, odd's of catching and trying the person would be nill! Sixteen years ago they broke into my house, among the items took was a 12 guage Mossberg Shotgun, the police call me up every year to see if I got my shotgun back, I haven't, but I replaced it. Unless they find it in a car driven by the thief driving without his seat belt on, they will never find anything, all they do is enforce the Seat Belt Tax Law, The fines are what supports our tax base.

Crooks here are much safer here than taxpayers. Jim

Wow, you put an enemies list in your sig. You are seriously vindictive and hostile. I've **never** seen a list like that on any forum I've read. It's a nadir of decorum and I'm surprised that it is allowed even in a loosely modded forum like this one.

It's not an 'enemies" list, it's a "noise" list.

There's a difference. New people should know that there are accounts that post garbage...

No, there really isn't. You are attacking the person, not their arguments, to cut off people you don't like from being able to engage in legitimate conversation as if it is your forum. You are preemptively trying to deplatform people so that nobody but you can decide what is useful, interesting and true. You are also trying to "other" people, calling them "things" rather than people. It's pretty offensive.

Point me to where in the terms of agreement it says we can't put a list of the people on our Foe list.....
and why they are on our Foe list is really nobody's concern but our own. You should see my Foe list   quite lengthy.

I repeat folks...just because you don't happen to like what someone says or how they say it....doesn't mean it violates the terms of agreement in some way.

I see stuff every day that gets said that I don't particularly like but I don't/can't do anything about it.... just because I don't like it doesn't mean it violates the terms of agreement and that is what I have to go by....terms of agreement and Johnny's inclination to have as little censorship as possible. Johnny still holds the belief in the inherent good in people and IMHO keeps hoping that people will grow up from the 2 yr old mentality and adopt the Golden Rule and be adult about disagreements. I won't be holding my breath on that one but it's like I always have said....this is Johnny's sandbox....you don't like it you don't have to play in it.

Get back on topic and quit derailing this thread or no one will be posting in it anymore.
