Government Will Mess with your CPAP

After all the good development of technology and choices in manufacturers and features, our Johnny-come-lately FDA is going to get involved and screw things up.

"I am from the government and I am here to help you." Sure.
FDA Takes Closer Look at In-Home Medical Devices
WASHINGTON -- The FDA is trying to make in-home medical devices safer and easier to use, according to agency officials.

On April 20, the agency announced a multipronged initiative to more closely scrutinize medical devices used at home and to offer guidance to their manufacturers. The FDA said it will:

Establish guidelines for makers of home-use medical devices. There is currently "no clearly defined pathway" for device manufacturers to have equipment approved for home use, Jeffrey Shuren, MD, JD, director of the agency's Center for Devices and Radiological Health, said during a teleconference. "FDA will develop guidance documents for actions that manufacturers should take to get clearance for home use."

Develop a home-use device labeling repository. Through a 10-month pilot program beginning in midsummer, manufacturers of devices labeled for home use may voluntarily submit their labeling electronically to FDA for the agency to post in a central location on its Web site. "Posting medical device labeling in a single online location will make it easier for home care patients and caregivers to find important information about how to safely use their device," according to an agency white paper.

Partner with accrediting organizations to train home healthcare providers in device use. "Assuring that [home health] practitioners are adequately trained in the use of medical devices in the home can be daunting, given the wide variety of technologies that are used, on- or off-label, in the home," the agency noted in the white paper.

"Therefore, FDA is partnering with two major accrediting bodies for home health agencies, the Community Health Accreditation Program and the Joint Commission, to review and strengthen accreditation criteria that relate to medical device safe use practices for the home environment."

Develop guidance for postmarketing surveillance. The agency will continue to promote use of its Medical Product Surveillance Network (MedSun) to report problems with home-use devices. In addition, FDA will work to identify situations in which devices not intended to be used outside of a healthcare facility are being used in the home.

"In such cases, FDA may require that premarket submissions for these devices contain either labeling for home use and use testing specific to the home environment, or a statement in product labeling clearly indicating that the device is not intended for home use," the agency noted.

Increase public awareness. To educate the public about issues related to home device use, the FDA is launching a new Home Use Devices Web site featuring information about using medical devices in the home and strategies to reduce the risks associated with home use.

The agency has already developed three informational brochures about home healthcare -- a home medical device checklist, an infusion therapy checklist, and a blood glucose meter checklist -- which are available on the Web site. "We think home care can provide tremendous benefits to patients and we'd like to encourage its use, but we'd also like to ensure that the devices used in those settings are safe," Shuren said.

You didn't really think that the medical "establishment" was going to let us "skirt" their fee structures did you

I had a total hip replacement and was sent home in three (3) days (It would have been an overnight one (1) day but I have complications so they wanted to keep me under observation),

So we have the Hospital and the Insurance Co. pushing you out sooner and now they (FDA) are afraid that we will do things "on our own" at home

Again, we the poor consumers, take it in the neck

This is going to end badly (IMO)

-- It sounds like a good idea to me. You have DMEs that are not really trained in use and are probably not very well educated at all. Government regulation can help prevent abuses. I guess having worked in the Consumer Protection Division of a gov't agency, I have seen the other side and know there are many abuses against the consumer that need oversight.

Yep - insisting that the DME's know what they are providing and are capable of instructing people in its use is a GOOD THING.

It will also be the place to complain when they are not doing their job. Obviously the free market system isn't working here.

As I expected, the promoters of the nanny state are starting to chime in.

We need big old papa government to take care of us poor pitiful wimps.

We are uncapable of going into the market place and dealing with suppliers on our own.

We are uncapable of evaluating products and services and making our own decisions. We are uncapable of educating ourselves and helping each other.

We are uncapable of recognizing deceptive advertising, sales and marketing techniques and shunning those companies and telling all our friends about them.

What are we doing on this forum? Let's get a government agency to come in here and revamp it and get us straightened out.

We are so poor and pitiful. Big government please save us!

If you people need help from the government to keep your underpants clean, then go ask for it, but leave me out.

Government is such an awful thing....

It provides roads for us to drive on, clean water to drink, some basic work place rules so the big corporations don't treat us all like slaves (like they would like to), and my all time favorite, when I flush the toilet, the turds go away.

"We the People provide roads to drive on, thru TAXES, lots of TAXES. We pay for water from TAXES and charges from private business that use GOV Guidelines for the specs of water safety, to which they add fluoride and other chemicals to ruin our health in the long run. The Government provides very BASIC workplace rules, the don't help much in keeping us from being slaves of Big Corporations, and are more designed to favor the Big Corps and big business, rather than the working person.

When i flush my Government mandated low water usage toilet the TURDS go away on the third Flush, where if the Government had left the low water standard out, one 3 1/2 gal flush would have worked the first time, saving the earth 1 1/2 gals of water use.

The Honorable JeffH mentions government roads. That's not going so well in my home state.

Governors want to do favors for their biggest supporters and friends.

Legislators want to maximize the flow of funds into their districts as a means of buying votes, with the more-senior members having the greatest opportunities to do so.

City and county officials want to move their local projects to the top of the list.

If a corporation had to take the state funds and invest them in roads for return, they would focus on projects, wherever they are located, that promise the greatest bang for the buck in alleviating traffic congestion and improving safety.

But no, government doesn't do that. It is all about favoritism and getting reelected.

As a result, roads of inadequate quality and capacity reduce the incomes of our state residents and visitors by billions of dollars a year in lost time, lost fuel and vehicle repairs.

Leave my CPAP alone Big Brother.

I wouldn't say incapable of it, but let's take a look at something that has been recent. Can we say "Vioxx" which Pfizer still claims is safe. Yes in short term it is safe, however since arthritis doesn't disappear, why bother marketing a drug that is short term for a long term disease. If the government hadn't made them pull it off the market, I bet that it would still be in use today.

Not poor and pitiful, but rather mesmerized by giant corporate advertising, believing the false promises of what the product will do and then left to wonder if the product is working. It is one thing if the FDA announced that they were regulating the "As Seen on TV" ads, that in my opinion is going to far. But if someone could die from a product that is for in home medical use, maybe there should be some oversight. Remember that right now we are at the mercy of the DME's and the manufacturers. If something should make it to market with a bad design, who will listen?

I might be one of a very few here that believe that all xPAP equipment should go through the clinical phase trials much like new medicines do now. Would we see the disaster of the M series humidifiers or the still uncorrected ComfortGel clips? I doubt it.

Government makes it possible to have accountability. Don't believe me. Then if you have any type of work done to your home and don't have it inspected, see what the contractor tries to get away with. Just watch "Holmes on Homes" on HGTV. Yes it looks nice for a little bit but then problems occur and your left holding the bag and a very expensive bag at that. But since you don't like government involvement, maybe you will die a quick death in the house fire that started from bad electrical work and then caught the unsealed foam board on fire making a lot of toxic smoke that debilitated you before you knew that there was a fire.

I guess while people can still be responsible it is the wish of the private insurance companies to refuse insurance for stuff like existing conditions etc etc.

If the medical industry is taking away my choice to purchase coverage then all I'm left with is my vote to kick their ass

I'm hoping they self regulate.

I think that adds to my point. Vioxx was widely prescribed because the FDA had approved it. Doctors and patients trusted the drug because of government approval. So if the government is capable of protecting us sheeple, what happened here?

Besides the final story on Vioxx is not yet known. There is significant debate about whether it improved health or hastened death of the deceased patients. Cases of families of deceased patients have almost all been unsuccesful with judges throwing them out or juries finding Merck not guilty. Most of the deceased had serious health problems that portended their deaths with or without Vioxx.

Worse, patients taking Vioxx have mostly been switched to naproxen and the outcome of this is uncertain. It certainly could be that the great majority of them would have longer, healthier (or less unhealthy) lives taking Vioxx as compared to naproxen. I point you to this thread, viewtopic.php?f=1&t=50061&p=459603#p459603, on the effect of naproxen on sleep architecture. I believe the information in the thread to be accurate. If naproxen has a negative effect on sleep architecture and Vioxx doesn't (this I don' know), then the withdrawal of Vioxx from the market might have been a bad mistake.

In any case, we are running off in all kinds of directions, electricians, roads, turds, and missing the OP main point that our freedom and ability to treat our apneic condition at a reasonable cost is very likely to be hampered by the FDA action.

As far as you wishing for my death in a house fire, I certainly don't want someone with that attitude making government policy.

No I wasn't wishing that you would die in a fire. My point is where as a society do we draw the line. Do we say that buildings should be inspected and medical devices shouldn't be. You can die from both if they are made badly. I would prefer that anything that I can die in or from be inspected by an agency (why it is the government in many cases) that has no connection to big money.

As far as Vioxx goes, Pfizer hid a study they did that showed that long term use could lead to cardiac events. Then to top it off, they hid it from doctors as well. But as you said many aren't winning their cases because of previous medical history.

I do miss Vioxx as it worked well for my lower back pain. But given recent events, I wouldn't be taking it either.
