ebay is a big target - they don't sell guns on eBay anymore because it became a big deal - not that most of the people selling there would sell to you directly - they were so worried you were a cop that they would follow every law strictly - for good reason - they would send the gun to a dealer local to you who would then actually transfer it to you - or sell it to you in person if their state allowed cash sales - but then, despite the fact that no one sold guns on eBay - they only agreed on prices and sales were handled through dealers who took fees, well, a zillion news reports came out saying, "Look how easy it is to buy a gun on eBay!"
eBay then stopped handling guns. You can buy them on auctionarms -- or, rather, you can agree on a price and the sale is handled by a local dealer.
The point is that eBay is a big target. If someone can whine loud enough, eBay will stop handling something - this notice probably gets eBay off the hook. If you don't include the notice, eBay will cancel the auction, and for some items, they may just decide that there is no good way to handle the item at all.
Someone may have talked to eBay about people self treating for osa and the dangers thereof, and their potential liability for reselling prescription devices - if someone could come up with a good use for these, like as aquarium pumps - the o2 generators are frequently sold for glass blowing - you can get a very hot but not horribly large flame out of propane and O2 - and if you do it much, a used O2 generator is a cheap way to go - but it might also be that you can buy a used O2 generator if you are sick and need O2 for less than it will cost you for the Co-Pay. With no non-prescription use for pumps that can't pump into a deep aquarium...

Of course Ebay can cancel anything that violates the rules that you agree to abide by.
I think the others did a good job of describing the most likely reason for ebay prohibiting the sale of CPAP machines. Liability is a very powerful force in the world we live in today.
I personally think it is pretty sad that the government thinks we need so much protection from ourselves that they even have prescriptions on stuff like CPAP, decent cough syrup with codine, and now we even have to deal with Pseudoephedrine limits.
I go to Walmart and buy their generic Antihistiamine/Decongestent when I get there, which isn't very often, since my Walmart is a bit away. I it takes a bit of gas so I like to stock up for the cold and flu season when I happen to get there.
Now, I have to sign my name at the pharmacy counter and can only get one bottle. I have 4 people in the family and they all get sick occasionally. What if I had 6 kids? They want me clogging up the road, wasting more gas to drive there multiple times so I can treat my families sniffles all so I can't make crystal meth? I am willing to bet that the folks that brew crystal meth don't have any problem getting all the generic antihistamine/decongestant that they want without signing their name at Walmart.
Sorry to sound so sour but I feel that our personal freedoms are being eroded to the point where soon there won't be much left.

Some time back someone posted info indicating that Resmed was the driving force behind eBay banning xpap sales but it makes more sense to me that it would be all the large manufacturers behind any such move.
There is a growing used cpap market plus a growing demand for cpap machines but the manufacturers are not happy about the 2nd hand market as it reduces new machine sales & too often they (because the product has their name on it) get a bad rap if the used machines are defective or a problem in some way.
If they were perceived to be endorsing 2nd hand sales, then it stands to reason that 2nd hand purchasers would eventually want access to service from the OEM companies.
But because these machines by law, require a prescription, the manufacturers are in a very good position to pressure eBay as eBay acting as the agent of sale, has no means of enforcing production of prescriptions. Everyone knows that producing a prescription to an eBay seller is a joke.
One other point of interest is that at this moment eBay & Yahoo are in talks about the possibility of consolidating & sharing their facilities. If so then it is possible that Yahoo's auction facilities might merge with eBay's & if that were to happen then Yahoo's current unpoliced xpap sales will come under control of eBay & thus share the same fate.
Interestingly, eBay seem unable to stop sales of masks. I myself received a letter (email) from eBay telling me they were banning sales of masks after I sol 2 unwanted ones, but I see little evidence they have succeeded in killing mask sales off.

selling cpap masks
I have new cpap masks I was trying to sell on ebay and they yanked them a while ago. Any suggestions on selling new masks?? I was trying to sign up for yahoo auctions but it would not verify my information, I kept getting an error message. Let me know if anyone knows of any other auctions sites to list these on. Thanks!
