Ebay removed my auction

Post by SleepyRose » Tue Feb 17, 2009 7:25 am

I had a Devilbiss heated humidifier on ebay, just listed it yesterday.

MC036 eBay Listing Removed: Medical and Prescription Items (275452033) Feb-16 --
If there is a potential issue with your account, eBay will send you an alert.

I didnt realize that it was a prescription item! I bought it without one.

I don't think it is a prescription item - but apparently ebay perceived it as one.

Heres my official reprimand.

You recently listed the following auction-style listing:

290296872646 - Devilbiss Heated Passover Humidifier

Unfortunately, we had to remove your listing because the following information violates our policy:
Continuous Positive Airway Pressure (CPAP) devices that require a prescription are not permitted on eBay.
We notified members who placed bids on the item that the listing has been canceled.(I HAD BIDS!!)

To protect consumer health and safety, sales of drugs and other medical items are heavily regulated. For this reason, listings for drugs and other items that require a prescription from a doctor, dentist, optometrist, or veterinarian are not permitted on eBay. Listings for other health care or medical-related items are severely restricted. Bilevel Positive Airway Pressure (BiPAP), Variable Positive Airway Pressure (VPAP), and Continuous Positive Air Pressure (CPAP) machines can only be sold by prescription. For this reason, listings for these items are not permitted on eBay.

I was browsing on eBay the other day...and they blocked me from certain listings with:
Dear User:

Unfortunately, access to this particular listing or item has been blocked due to a Paris commercial court decision that bans trade of certain authentic perfumes and cosmetic products on eBay because of French selective distribution laws. eBay is appealing this ruling but is nevertheless required to enforce it. We are blocking your viewing in an effort to comply with this court decision. Regrettably, in some cases, we may prevent users from accessing items that are not within the scope of the decision because of limitations on existing technology.

Thank You.

It's just not worth dealing with Ebay for any cpap-related products. I use cpapauction.com, and craigslist, if I'm looking for used.

https://www.cpap.com if I want new.

Now SHOES, that's another story.... (I bought three pairs of shoes on Ebay while visiting my father in the hospital - love that WiFi!)

Cheers,
B.

Hello, Cpapauction is not much better. I tried to bid on an Fingertip Pulse Oximeter. It said I need a prescription! Gee now you can not even check your own oxygen without a Dr. Ok?

CPAPAUCTION is a good place to buy but a bad place to sell. The audience is too small and competition too great and people want stuff for way too cheap.

It does seem like the traffic there is pretty thin. You do get great deals though.
Maybe I'll keep it for a spare or use it to reheat my coffee.

I emailed eBay about this...turns out they are complying with the ruling by blocking access to the entire "Health & Beauty" category. It been blocked for like a month now....wonder if the sellers know that the reason they keep wasting their listing fees on stuff that isn't selling is because eBay is blocking their listings because they put it in the 'wrong' category?

One has to get lucky to make buyer/seller contact prior to CPAP's getting pulled. I my came yesterday that I found on E-Bay last week. It is not easy to pick up a CPAP machine without an RX as it was in the past but Craig's list seems to work for some.

Rose you may want to reword and relist your item.

unfortunately in this day & age everyone is trying to cover their butt .homeland security, TSA, lending institutions, HIPPA,& even ebay.must be more ambulance chasers than ambulances. even ebay with it's quirky policies....i had a handgun holster on last year. that was fine, just don't show what will fit in it even if in your bold text that weapon is not up for bid. so i would not be surprised they would choose to run like lemmings to avoid any possible litigation. fact of life today
