troubles at work
well today the manager at the store said that he did not know that I came to his store cause Of my health and he says that he can not work me what I ask, which was 8 to 4 only 5 days a week, he says I have to be able to work 6 to2, 8 to 4 and 4 to midnight, and I really dont think I can do that and oh I have to do it 6 days a week, I am going to have a meeting tomorrow and the big wig is going to tell me where she is going to put in now, I am sure it is farther away from home, so Iam thinking I am going to hear what she says and then say no I am going out on sick leave, I have a serious condition and I need to care for my health, do you think that is a good idea and will my doctor agree with me and let me stay out for a little while till I can figure out what to do
Did you say yesterday you were talking to the union rep? What do they say?
Working several shift might be expected in your job and allowing you to not have to work them might be considered an "unreasonable" accommodation under ADA. It might be that the management will allow it and consider it "reasonable".
There have been cases files with EEOC about this issue before and I don't know all the outcomes. I imagine if you were to consult an attorney who specializes in employment law you might be a better idea of where you stand.
Did you find out the process needed for a request for ADA accommodations? As I mention in my post earlier on the other thread, such a request (if the workplace decides the request is unreasonable) might mean the loss of your job. I have been that route myself after other requests were granted, the last one cost me my job.
Keep a good record of paperwork and notes of conversations with all of these people.
As far as what your doctor will or won't support, I sure can't comment on it. Sleep apnea is a serious condition yes and getting the treatment under control is crucial. I would want to discuss that with my doctor before I made a decision on going out on sick leave myself, especially if I needed the doctor to write a supporting letter. When can you go in and see the doctor next? or can you fax the doctor a note about what is going on, and get them to call you back.
