I have honestly never tried to sell a used machine, but it is my understanding that if a machine has less than 40 hours on it , it can be sold as a new machine. Anything over 40 hours and it has to be sold as a used CPAP machine. I personally use the used machines as loaners for CPAP trials for patients who cannot afford treatment. I would get in contact with your DME and demand a new machine. Part of the contract that they should have with your insurance company requires them to dispense new equipment.
I have an S8 Vantage. I checked as tmaiberger suggested ... and the difference between my usage hours and the run hours was 36 which according to KansasRT may still be sold as new. Fact is my machine was used by 36 hours ... perhaps nothing to complain about. However, it is possible to determine if your S8 is "brand new" or "DME new" or outright USED!

President-pretender, J. Biden, said "the DNC has built the largest voter fraud organization in US history". Too bad they didn’t build the smartest voter fraud organization and got caught.

The DME got back to me today and I told them the insurance co. said I should have been given a new machine.
1 hour later, a brand new(in the box) RemStar M series w/cflex was delivered and set up at my home. I told them to disable the cflex, though, because I didn't think I would like using it. I wasn't prescribed for it, and I was doing fine without it.
I did notice that this brand new machine seems to have a bit more "force", but I'm sure I'll adjust fairly quickly.
I'm quoting me here with an update. The new machine is REALLY great.
It's even quieter than my old RemStar Plus, and it definitely has more airflow pressure, which probably means I'm actually receiving the prescribed pressure.
My previous machine was just turning over 4000 hours when I turned it in, so it probably wasn't working in peak performance.
It's a happy ending to the story, but I swear, sometimes you can never get what you want without a whole lot of complaining!

Machine

When I received my machine it was still in the box and wrapped in plastic and it did have 0 hours. From what I have seen on some of the posts I have read I'm not terribly surprised that some DMEs would try to pass off used machines as new. OPne would hope the DME induustry would want to build more a reputation based on trust, but apparently it doesn'y matter to some of them.
Happy to hear you caught it and received a new machine like you and your insurance company paid for.
