Maybe so, but the legal issue I raised is genuine. They cannot create a medical record and sell it to others and not give the patient access, by law....not sure that was actually listening. the way i read it is the were telling you to pipe down and that the grownups had it under control. along with a lot of eye rolling on their part.

The decision to make therapy data a BONUS revenue stream is potentially a disaster.
Insurance--especially Medicare--will not pay for it.
The only patients who can get data will be those who can afford concierge medicine.
Sounds a lot like respironics has jumped directly on the "death panel".
Is this, by any definition LEGAL???

Does anyone know if there would be any chance of the insurance company covering a ResMed device if I claim that it is a violation of my HIPAA rights. What is the best way to get a ResMed machine covered?

How long has it been since your insurance company paid for your cpap machine?
You might have some recourse if it has been over 5 years. No guarantee though. It all depends on the insurance company.

I bought my first Autoset out of pocket, when my S9 Elite was only 9 months old.
I was able to re-titrate my pressures, eliminating aerophagia.

I have not been on the forum for a while because things were OK and they still are.
When I got my replacement Dreamstation 2, I came looking for the instructions to obtain the clinician's manual for my new machine. I have not been able to find it. Has something changed or do I just need to look harder?
This topic clearly got my attention and I didn't want to possibly stir the pot with a new topic. Sorry for hijacking the topic.

I've followed some of these threads with amusement.
In many ways, nothing has changed over the years. Only a brief departure from their norms.
Both ResMad and Respironics (Philips/Respironics) used proprietary data encryption in their machines from the "get-go". They (one or both) are probably now reverting back to their pre-unencrypted days.....(prior to 2010)
ResMad used proprietary software "ResScan" and data cards/card readers in the S7 and S8 generation machines.
Respironics used proprietary "Encore Pro" and Infineer/Mako smartcard cards and readers in their Legacy and M-Series machines.
For whatever reason they BOTH decided to make a departure from them in 2010 with the newer SD card technology.
The big difference is that most of the "new" users since 2010 have gotten used to the home-grown software and data storage that came with the newer System One/Dreamstation 1 and S9/AS10/AS11 machines which allows them to see their own data.......as they always should have.
I'm sure that there's another version of Encore Pro to read the encrypted P/R data......if you can find it.
Give them some time and ResMad will probably follow suit.
They've been "kind" to allow the users to view some of the data in the LCD screens and that is probably enough to get them off the legal hook with the HIPAA Laws. Yes, it's YOUR data, but in reality........THEY DON'T GIVE A DAMN ABOUT YOU!
