Well technically, sleep apnea is not a disability. So the question is are vets getting payments for unresolved issues related to sleep apnea which according to the ADA if I remember correctly constitutes a true disability if they qualify under the definition? In other words, if the apnea has resulted in cognitive impairment that has caused a major impact on activities of daily living, that would be a legitimate disability. What exactly are they getting disability payments for? That is a legitimate question to ask in my opinion.
Before anyone flames me for being against vets, in my opinion, they have been royally screwed by the system big time regarding getting disability payments for other problems and for being mistreated by the medical system.

Sleep apnea is a treatable condition, not a disability. I use a cpap to treat it. I also have an eye condition...nearsited. I wear eyeglasses to treat it.

One day post Memorial Day. The very Day our Fathers, Brothers, Sons and Daughters gave their all so we can bitch about paying for a chin strap.
How could you even think in those terms? My stomach actually turned as I read that. I’m guessing you are pissed at the vets that are receiving a disability payment related to OSA and Agent Orange. Or, perhaps, the in country vets who now deal with (and always will) diabetes. Yes they receive a monthly check….even if only one foot touched down in Vietnam. Getting OSA from sucking in Agent Orange. Hmmmmm, How did you acquire OSA ? Too much salad? I don’t think so. Too much pizza, more likely.
If I ever had the opportunity to meet you I would have this tattooed on your face

Since many people have difficulty using cpap, including some here; would it not be fair to assume many military may have the same problems?
In fact, exacerbated further by physical and mental trauma experienced while serving their country?
Treatment is not always possible-or effective!
Vets several decades ago had much difficulty getting Agent Orange to even be acknowledged.
It looks like the same ugly MIS-treatment of our vets has never ended.

Military "Disability" has absolutely nothing to do with the ADA, those definitions are not even considered in the determinations for claims. Service members (for the most part) recieve disibality pay based on the criteria that the medical problem (or problems) was created or exacerbated by their military service. With that said there are a lot of Service members who ignore thier symptoms of sleep apnea until shortly before they retire or leave service. They go for a sleep study get a diagnosis (and a PAP device) and recieve disability pay. There is currently a plan waiting approval to award disability pay for sleep apnea on a sliding scale, currently service members recieve 50% disability for service connected sleep apnea.

It also appears that apnea may be associated with Traumatic Brain Injury (TBI).

TBI is a common problem with vets who have seen combat that otherwise left no visible mark. Contrary to my earlier, sarcastic post, I truly believe they are entitled to everything we can give them.
If you haven't seen Jon Stewart's Daily Show rants on VA admin., you should check it out. (Even if you think he is a horrible person because he's a libby commie pinko, and all that, you may find yourself agreeing with him on that issue. Just google Daily Show and VA.)

Thanks for correcting me on that ackpapguy. But it still seems the issues are the same. Again, I have no problem with payments if there are any lingering issues such as EDS and cognitive problems. But if someone is fully functional after receiving pap treatment, getting disability payments doesn't seem right.

We have the opposite case in our family. One of the cousins was diagnosed in 2009 with PTSD from Vietnam and gets 100% disability. After a couple of long talks with him about his symptoms and my sleep apnea symptoms, we have both been convinced that his PTSD does not exist and he actually has severe sleep apnea.
I tried to get him to go to the VA for a study and a CPAP machine. He refuses because they might cut him back to 50% or zero.
He is a good bit younger than me but I bet my CPAP keeps me alive for his funeral.

Some studies, as you know, show only 20% are able to use CPAP for more than 4 hours a night at the one year mark. But let us be generous and say that perhaps 50% are able to do that.49er wrote: if someone is fully functional after receiving pap treatment
But of that 50% how many still suffer from excessive daytime sleepiness? How many have undetected respiratory effort related arousals? How many still have lots of apneas and hypopneas from unmanaged pressures?
Probably the 50% disability is based on actual data.
