Respironics Pricing Strategy (Feb 1 2013) IS THIS LEGAL ?

Here is the Respironics
US pricing, advertising, and sales channel policy

This includes the Mininum Advertised Pricing (MAP) on all the current product (but not accessories).

Also covers what happens to a re-seller when they DO NOT obey there strict reselling rules etc.

This looks like it borders on violating Anti-Trust Laws in the Price Discrimination Category.

Can someone with more knowledge in this area chime in.

I didn't read the entire site, but it sounds similar to Resmeds policy.

What is of even more concern to me is that I believe they know much better ways to treat Obstructive and Central Sleep Apnea - but - if you expose just a bit of this at a time you can make the new machine cost more so they do.

It will all probably come back to bite them as nations take over PAP production and perhaps un-monopolize these very greedy people.

May that time be soon!

I see on p5, para 3, that retailers cannot say that the products are subject to a pricing policy - but we can!!!
On p5, para 7 it says that retailers are only allowed to sell in original packaging, and cannot alter the product packaging. Does that mean that if the DME opens the package without us being present they are breaching the terms of this strategy?

In other words, the DME's who help themselves to one or more of the pillows
or cushions in a multi-size pack are violating the terms of their agreement with Respironics?
We will see if this makes a difference.

If anybody wants to bother to go up to the Search line and put in "MAP policy", they'll find that this type of thing goes back to at least 2008.

Why do you think the manufacturers are referred to as the "Medical Mafia" on the forum.......they earned that label.
So, the next time you think the prices of this "medical" stuff are too high, you know who you can blame.
They all have their own methods of coercion. P/R isn't the only one.

I don't know how legal this is, but this is why you really MUST call (or email, etc) the DME, including our host, instead of assuming the internet price is correct. I saved HUNDREDS doing this. It matters!

This is why when a DME is providing an opened mask package with two sizes of nasal pillows missing, it might be worth calling the manufacturer and getting THEM on the DME's case.

Does this mean that IF i decide to sell my used PR System one BiPap Auto W/ Humidifier & go back to straight CPAP with my M Series ,i could not sell privately ????

It's very much illegal, however, the US government has sold out and won't enforce the law. There's zero chance anything will be done about this.
