What Do I Do About Ex-DME Picking Up Their Equipment?

Now that I have my new DME and the gear that I want, I have my ex-DME's equipment sitting by the back door for pick-up. The senior case mgr. at my insurance said they were issuing some sort of notice to them to pick up their stuff. I was told not to move the gear or contact them. I see in my old contract that I am not allowed to move this gear anywhere and it must remain in this location, until their representative picks it up.
Has anybody dealt with this situation? Should I do anything further to protect myself here? My insurance says they cannot bill for anything from yesterday on, and that I am officially no longer a client of theirs.
Advice? Thoughts?

oh and....i slept 8hrs last night and i feel great!!

Don't have an answer for you other than maybe you want to issue them an invoice for "Storage Fees" depending on how long they take to pick it up! Imagine the look on the person's face when you hand it to them? Of course, they won't pay it, but it may cause them to think about how they treat others.

Sounds to me like you are in the clear according to your Sr. Case Manager from your insurance. I say, let them in to pick-up the Machine/Gear, then 'show them the door'! Your fight with them is over and you have come out on top!!

do exactly as your insurance company told you and don't worry about it. be sure to document all conversations pertaining to this with names and times, etc. you may want ask the case manager to give you something in writing re-stating what he has told you.

I would review the contract you signed with first DME; sometimes in the small print you must agree to be responsible for any charges refused by your insurance. If they take their time picking it up, they could try to make you pay for one month rental. Especially if the relationship has become acrimonious.

If you decide to bring it back yourself, I would insist on a dated receipt listing all equipment returned and hours on the blower, if any (I don't remember from previous thread if you used it one night or not).

You might want to send a registered letter stating that they must pick up their equipment as per the insurance companies instructions.

Have copies of something similar (with detailed list) available for the pick up person to sign.

I think I would also take pictures of the machine date/time, Blower hours, and at pressure to confirm the condition.

Write out your own receipt for them to sign.

Take a picture of the delivery guy with the box in his hands. Maybe a video.

I'm not a member of the "DMEs are all evil, insurance companies are all saints" sect here. If it were me I'd want to be absolutely sure that the DME HAD actually been told to 'pick up its equipment. And I wouldn't trust the insurance company to handle that. After all you signed for it.

Yes I DID sign for it.....By the terms of their own contract, I also have the right to return it. Thank you very much.

When my insurance company changed suppliers, the old supplier sent a messenger to pick up my old machine. I think they called me to tell me when they would. It was done within about 3 weeks. I got a receipt.
I gave it to them without the SD card in it.
