Trucking company Celadon admits S.A. caused death

As part of the 3.25-million dollar settlement reached this week, in which Celadon admits that sleep apnea most likely led to the death of John Lindsay, the trucking company agreed to examine its operations and policies in an effort to prevent similar accidents in the future. They also agreed to educate its drivers about the dangers of sleep apnea.

Attorneys for the Lindsay’s hailed this week’s settlement as a major victory, calling it the first case in which a trucking company has acknowledged a death resulting from a driver with sleep apnea.
It's a start in the right direction.

That driver should be up on Charges as he KNEW he had the condition and did nothing about it, totally irresponsible.
Although no criminal charges were ever filed against the driver of the 18-wheeler, it was later discovered that he suffered from severe uncontrolled sleep apnea, had been fired from previous driving jobs because of his refusal to get help for that condition, and that 30 other trucking companies refused to hire him.

I have to agree. The company is responsible if they knew he had the condition and didn't fire him for not treating it. (side note, if they didn't cover his treatment they're even MORE responsible)

The driver is criminally responsible for endangering everyone on the road for driving while knowing he was impaired.

Both sides of this equation were in major error.

As a retired truck driver, I can tell you that the trucking company and the Doctor that issued the Medical Certificate are both in the wrong. If a driver is diagnosed or even suspected of having OSA, they cannot drive until treated. Every year and upon demand, the driver must prove compliance. This all per the FTHSA (former DOT). This may not be the end of this story, the trucking company and doctor could both face further actions by the government.
