I hate my shady DME and Doctors office

I have been trying to get the order for my autopap now for 2 days. The office will not fax this to me nor will the DME company. I am about to go crazy. They are treating this like a secret. I am starting to believe my doctor is someone affiliated with the DME. Is this even legal???

I had the same exact problem, I had to file a complaint with the hospital because its actually against the law for them not to release a prescription or your records. Try to call the place you got your sleep study, sign a release and request your records or do the same with that doctors office. By law they have to give you that information. Thats what I had to do. The DME would not give me a written copy either. Thats what your after, a written copy of the script. I took that to another sleep doctor and had him change it to APAP and written to say I could get whatever mask I wanted. With that you can go to any DME or like myself since it was out of pocket I used CPAP.com. I had a hell of a time and was operating with no sleep, hang in there. Once you have that prescription along with this forum you will be able to take control of this thing.

The Cuda and the Frog are right. Take their advice and act on it.

The medical industry works hard at "livestock control"...us being the "livestock".

Refuse to be "bovinely compliant". Hang a horn in 'em if necessary.

I concur. Everyone should get a copy of their "script". If it's not correct, have your physician correct. Most of the time they are accommodating, but if not, it's still your choice who you choose for your care. Exercise your rights!

What reason do they give for not faxing you the scrip?

Folks this is a good example of why I believe we should be able to go get the sleep test, find out what our pressure should be, and then go to your favorite retailer and buy our machines over the counter without any prescription. There are too many DMEs out there that are harming our brothers and sisters with their lazy, incompetent, and greedy attitude. This man is being punished because he wants to take control of his health needs. It is a crying shame this kind of behavior takes place in the medical profession. It happens way too often.

Jobe don't lose your cool. Be business like and demand a copy of your prescription! Call your Attorney Generals Office in your State and ask for help if need be.

I'm new to all this, but I just don't get how this is allowed to continue. How can they get away with it without someone(s) pulling the plug on them? This does after all have something to do with the medical profession. My internist and a sleep specialist (doctor) are both involved in my care. I'm guessing most of you are in the same situation. Don't they know this is going on???

Are they refusing to give it to you or just refusing to FAX it to you? Will they mail it to your home or let you pick it up in person?

If they won't give it to you at all, tell them it's a HIPAA requirement. Pronounced "hippa". Sound like you know what you're talking about and don't take no for an answer. Google HIPAA.

Its a really long story but I asked the DME to fax me the copy they said they could not do that. I called the doctors office today and after arguing with the nurse I finally asked if I could have a copy of my order. She got very quiet I even had to ask if she was there with a ummmhmmm which made me even more mad! I gave her my fax number. I checked at 430 today and still no fax... They are just being ridiculous!

I would go in person, ask for the waiver or release and refuse to leave until they produce it, you sign it and you get your records in hand.

I would be waiting on my Dr's door-step come Monday AM, at opening time. Could be they are just "too busy" to fax it, esp on a Friday when the Drs offices (Fri phone calls are horrendous to Dr ofcs). Give them the benefit of the doubt and go IN PERSON to pick it up. I have worked at many Drs offices and they don't pay much, and some don't even have any perks, so often their receptionists who answer the phone are less than enthused to do even more work, and sorry to say, but some of the employees just don't give a d###, and some actually FORGET to fax as promised. Let's see what kind of song and dance they give you when you show up in person to pick the script up since it was not faxed as promised. They need to understand that they have kept you from sleeping for several days, because if you had the script, you could have already purchased your CPAP machine.

They may be trained to not give out medical information to the wrong person. There are scam artists, identity thieves, etc. who will try to get medical information they shouldn't have access to. HIPAA has scared some of them into being very careful about giving out any information. That's good.

Unfortunately, this leads to laziness in terms of being willing to do it right. It's easier to just say no. Once they've adequately verified who you are, they should give it to you without question.

Many sleep labs, doctors' offices, hospitals do not feel that they can FAX a medical record to an individual safely. My hospital never gives me any guff on a copy of any of my medical records - as long as I go in and pick it up in person - or - have them mail it to me. Interestingly, I can FAX a ROI to them and they can accept that for their records. This seems to be SOP in this area.
