How to get my RX from Dr

Post by adksleepygal » Thu Nov 04, 2010 1:21 pm

How can I obtain my RX from my Dr for the equipment or does the DME I was dealing with have it and can I now obtain it from them? What are my rights? I have no idea where to go next with this. Pretty tired though - maybe stressed from all the fighting with these jerks.

you should just be able to ask the Doc for the prescription. Seems to me that the regulation is under HIPPA that you're to be allowed the script (or a copy thereof).

Call Dr, fax RX, ???, profit! You have the right to take your RX where ever you want.

I just asked my doc's staff for one to pick up so I'd have it for my records, and I got it. It is your right to have it....
Yes, that blue eyed beauty is my cat! He is a seal point, bi-color Ragdoll. I adopted him in '08 from folks who could no longer care for him. He is a joy and makes me smile each and every day.

Both have it. You can get it from either. I would request in writing from both and see who is faster.

Do your homework and check your state laws too.

The board of health may offer some help also.

I just called my Sleep Docs office, identified myself and said "I need copies of my perscription, full sleep study and follow up notes." They said okay and where did I want them sent. I was shocked it was so easy!! LOL Isn't it terrible how we have come to expect the worse sometimes?

What is terribly sad is that we don't all have the experience you had. And when we are refused access to our records we may not know what to do. Or may believe the lies we are told.

The staff at my 1st (fired) sleep docs office told me that if it wasn't for HIPAA they would give me my records but HIPAA prevented that. The office manager insisted that in fact is true!

Isn't that terribly sad?

Well they are wrong. All Hippa states is that the Dr. needs to approve of your getting a copy of all that stuff. You will have to sign a request for them too. But they cannot withhold them for you no matter what anyone says - they could be take to court and bled dry. Remember, just because your insurance company pays for these things doesn't mean that you have no right for them. The insurance company pays for them for you! They are yours!

Complain to that state board ( a 1 page form to fill out) and they will make sure you get them if you have no progress.

Also note, depending on the size of the material you requested, you may need to pay for the copies. I've seen some doctors offices start to charge when the number of pages reaches 20 (or so). It all depends. However, the fee for the copy work should not be "unreasonable".
