Post by Billy6 » Sun Sep 12, 2010 9:58 am

I broke a part on my mask and I noticed the auction site has very few offerings of any type?? Is it closing down?

Nope. If you read more posts (posted earlier) you will note that Resmed now requires that NO Resmed products be sold on the auction site. So, until they can programmatically control what is auctioned, the CPAPauction folks have halted starting further auctions. Once they can guarantee that, CPAPauction should be back in business. Of course, this means if you use a Resmed product you might want to vote with your feet and find another product from another vendor.

I don't know about the auction site but if you tell us what you need maybe someone here can help you. I bet a lot of members have excess part collecting dust.

I shall be voting with my feet. They lost 2 sales because of their policies. A family member and myself will not be buying apaps from them.

It seems like a code could be developed by the auction participants to get around this ridiculous (and probably illegal) activity by Resmed. Call it R or something for Resmed. For those overzealous members who say (oh no its illegal to sell on an auction because it requires a prescription), I say two things, if your grandmother needed a wheelchair and you saw an add in the newspaper for a used wheelchair and that was the only way she could afford it, would you buy it for her or leave her bedridden. Wheelchairs requires prescriptions too BTW, the same ones as CPAP. If it really bothered me to sell something to someone if the equipment required a prescription, you could also simply ask for the prescription.
There are laws in most states against price gouging, the overzealous here on the board need to look up that law and consider the economic and human costs to price gouging.

Bump +1

I actually 'listed' a used Swift Fx because cpapauction.com was down. Got 3 offers within 24 hours. If cpapauction.com either goes down or restricts ResMed completely, I'm betting lots of folks will be posting for sale signs here!

el_zorro, I think if anything you'll find the zeal of the members around here leans toward rebellion against some of the controls placed by "the powers that be". However, the providers of cpaptalk, cpapauction, and cpap.com are licensed vendors who are obligated by law to follow certain criteria, and would be jeopardizing their business to thumb their noses at the rules. Private individuals are one thing, but being a business is another. Besides, if I thought they bent the rules sometimes, I would have to wonder when else the rules got bent. I prefer to know a company operates with integrity. Now, I've personally both bought and sold used cpaps, as I don't feel bound by the same obligations as a business. I too am more concerned with meeting a need. Just saying, I agree with you about bypassing the rules sometimes, but just if any risk of repercussion is on a personal level.

I would really like to see how the law applies to an auction site. Whether or not the business that runs the auction is responsible for enforcing the prescription laws or the individuals (businesses who sell on the auction site) are ? Just like if a DME has a hyperinflated price on a CPAP, who is enforcing this. Should we all be writing our Attorneys General to be reporting this illegal pricing activity ?

The prescription is not the issue, that FDA demand was enforced quite a while ago, on cpapauction.
The issue is the Australian company's insistence than their equipment should not be auctioned at all.
Since they can punish cpap.com any way they like for not complying with their demands, it is up to cpap.com to decide how they want to respond.

Its not about cpapauction. Cpapauction and cpap.com are both owned by the Goodmans our gracious hosts on this site. What Resmed are doing is telling them if they want to sell the Resmed brand on cpap.com they must stop selling it at cheaper prices on cpapauction. Johnny is between a rock and a hard place, what else can they do but comply. If they want to sell Resmed products at cpap.com they must do as requested by Resmed.

Started cpap in 2010.. still at it with great results.

E-Bay adopted a policy of not allowing ANY machines, complete masks, etc. anything that requires a script some time ago. The only thing that is allowed by E-Bay is parts (mask seals, headgear, etc.) that do not require a script. When looking it is obivious that some are taking a mask apart and selling it on three different listings (Frame, Seal & Headgear) and if you want to go to that much trouble I suppose you coud end up buying a comploete mask.
