Need a prescription?

Am looking to purchase a ResMed Air Sense 10 as a backup to my Air Sense For Her. I am using a DME for machine replacement (when it dies) and for all supplies. They handle the Medicare reimbursement. Cpap internet suppliers want a prescription for me to buy a cpap machine. Why? Sounds crazy. I don’t intend to go through Medicare or insurance. It’s Sunday and there isn’t anyone around to talk to at those internet suppliers.

Machines and complete mask packages come with a sticker on them stating a RX is required.
Yeah...might be a stupid law but it is a federal law and like other laws...we have to abide by them and that includes online suppliers.

Yet I ordered the F40 mask over the interwebs in the USA and didn't have to provide squat other than my credit card number.

Yet that doesn't mean that those interweb sellers aren't breaking the law.

I think it is a stupid law. Like who in their right mind would be buying and using this stuff if they didn't have a medical need and could probably get a RX if they tried.
But the FDA makes the rules....but they don't have a big police department to go enforcing them....or rather they don't bother. Finding a seller willing to break the law selling a complete mask without a RX is fairly easy but finding someone who will sell a machine without a RX isn't so easy.

While that may be the case. Just saying I have had no issues with obtaining a mask over the net without an RX. And even bought a mask (N30i) and a new cushion for the F40 locally in person without an RX. Even gave me a military discount.

Bottom line? A person can try and the worse the seller will do is say no, but might say yes.
And it's not likely that the A team will be called to dispatch Mr.T to your home to insure you don't try again. :D

Let me help you understand the regulations a tiny bit better. It's not illegal for you to buy without a prescription. It's not illegal for you to sell without a prescription.

In order for a DME provider (B&M or internet) to maintain their DME license, they must require a prescription. Failure to do so can result in fines and loss of DME licenses.
