So I am trying to get a copy of my prescription from my sleep md but the original firm split up, So I call the dr and the front office says i haven't had a prescription for 5 years so now I am a new patient and have to see the dr again and cannot have a copy of my old prescription, This is the biggest scam I have come across n a while. makes me mad, dr appointment 250.00 for a prescription I already have and should be able to get under patients rights and hippa

If he (or his staff) won't give you a copy...send him a letter quoting the hippa law.

This is why you should be compulsive about getting ALL of your medical records.

I agree that the way to go is to make a formal request for your medical records from this doctor including a request for a copy of your prescription. Expect to have to pay something for copying costs.

If that does not get a result that is satisfactury, then you can file a complaint with HIPAA including a copy of your request. At this point, you should only be communicating in writing using certified mail with return receipt to make a legal record.

Going this route will permanently sever your relationship with this medical practice. It will always be adversarial from this point forward.

Is there any chance that your DME still has a copy and that they will make it available to you?

Since it is the sleep doc that's digging in his heels, explain the situation to your PCP.
He, (or she) too can write a prescription, as can a PA.
If it's been this long since you've seen the specialist, your need for one is questionable.
If you are paying for equipment without insurance, you should look into other sources.
Local DME's are usually much more expensive than online.

Thanks everyone I called my GP he will write the prescription no problem, He might be the best DR that ever lived!!!

Don't be sure that you have access to your medical records in California:

South Carolina, most likely, has worse laws.

Speaking of the HIPAA(?sp) .... I recently had some blood work done at a wellness center that I belong too. I didn't need a Dr's orders to have it done and it was actually a 'lipid screening'. Well, I called to get my results and the office person said that she would lose her job if she gave them to me over the phone. Not wanting the gal to lose her job over it, I cheerfully drove over to pick them up in person. I don't know if she personally had access to the results but then again, she didn't offer to get the nurse in the office to give them to me over the phone either. My doctor's office nurse has called me in the past and gave me results over the phone. It is a strange new world we're living in and I know all about how this for my benefit and protection, etc.

Yep my GP wrote my script and the Letter of Medical necessity form that's on the CPAP.com website. No questions asked. He asked ME what I wanted written on it. Good that you found a great doctor. Stick with him. Lol!
