I have approached her twice for this and both times she refused to write one. I did get a copy of my sleep study and thats how I got another cpap machine. What she is doing is WRONG on so many levels yet she's the busiest sleep center and is screwing folks over left and right there. This is a great example of what is wrong with our medical system. My understanding is that the Federal Trade Commission is who I should report this to, I plan to do that along with reporting it to anyone that will listen, will even write a letter to our local news and who knows, maybe they will be interested.
The Barker sleep institute is doing nothing less than ripping people off, refusing to write a rx due to "liability"????? WTH difference is there between her writing one or issuing a machine from her office? If there isnt regulations about docs dispensing the machines to turn a profit there sure should be. They should be writing the script and the patient gets to fill it wherever they choose.

I don't know why your GP won't write the script...maybe you need a different GP?
Mine wrote my script. There was a sleep doctor that wrote the summary....and my doctor pretty much wrote the recommendation from the summary verbatim onto a couple of scripts. He missed the last line because it was on another page. And, that sleep doctor billed for his involvement.
Later when I asked for another script, he balked saying he can't think of why the TSA would need to see a prescription for my machine....and said if they do ask to see my prescription, then he would write one at that time. Didn't matter that I might be a little far away, etc. nearest airport that I'd fly out of (at the time) is in another state. Though a few months later I shortened the request to 'just in case'....and he wrote one.
First time was early (< 3 months), and I was having lots of visits due to issues....and in the end I also decided it was too early to take on the challege of CPAP and air travel, so I canceled the trip.... Second time was at my 6 month follow up.
Though in the window when I didn't have a copy of my own prescription...I did contemplate the purchase of a CPAP machine without a prescription, from that site that sells 'lightly' used and refurbished machines....
And, now that I have one....I still haven't gotten another machine....seems different machines have different features and tradeoffs.... plus since I still have issues, what machine I need might change....

My PCP, who pretty much diagnosed my OSA by just looking in my mouth, even though he knows next to nothing about sleep medicine, told me he would write me a prescription for any machine I wanted. I was still at that time trusting the sleep clinic to do right by me (big mistake) and let them do it instead. But I know if I ever want a different machine, I can just give the details to my PCP, who will write my next prescription. I'm done with that sleep clinic. My PCP is a keeper, however.

Please contact the Medical Licensing Board in your state to find out if what she is doing is prohibited. If it is, I'd try to get her or her staff to state it in an email. Even if they don't respond to your emails, I would send an email request everyday for my prescription to be sent to me (save your "sent" emails)...as even a lack of response can be used in a complaint against her.
If its illegal you can file a complaint against her -- and I definitely would. I'm surprised any insurance company would deal with her overcharging like that -- or does the exorbitant excess get passed onto you?
I know that in California optometrists are required to hand you your prescription for eye glasses if you ask for it, but not for contacts, so they can force you to always order your contacts through them. Totally unethical IMO, and so I always find out which side the optometrist falls on before booking an appt even though I don't wear contacts. Its rather disconcerting to hear that an MD might be able to legally do such.

Please contact your state medical board and state attorney general to report this Doctor, as this behavior is illegal in most states.

Come to Australia. Dont need a prescription to buy a CPAP here. You may pay a bit more though.
