CPAP in prison?

Post by WindFlyer » Thu Jun 26, 2008 9:46 am

What happens when a guy gets tossed into prison? Disregarding the guilty/innocent does he deserve it thing, if he's an OSA patient, does he get CPAP in his cell? Would they say the machine could bet taken apart and made into a weapon? Would they lock the machine in a box and just have the hose and mask coming out of it? Does anyone know?

What have you done?
President-pretender, J. Biden, said "the DNC has built the largest voter fraud organization in US history". Too bad they didn’t build the smartest voter fraud organization and got caught.

I can think of easier ways to get a free CPAP than doing something guaranteed to toss you into prison!!!

............William Thomas Meloy, a former inmate at the North Dakota State Penitentiary
(NDSP), brought this 42 U.S.C. § 1983 action against Dr. Bernard J. O’Neill, an
NDSP doctor, and Kathy Bachmeier, a nurse who is the NDSP’s Director of Medical
Services, alleging they violated his civil rights by failing to provide him with a
continuous positive air pressure machine (CPAP) to treat his obstructive sleep apnea
-2-
(OSA), a condition that causes him to stop breathing while he sleeps.

............

the law was clearly established that a
prison official’s deliberate indifference to an inmate’s serious medical needs violates
the Eighth Amendment.
Estelle v. Gamble, 429 U.S. 97, 104-05 (1976); Jolly v.
-5-
Knudsen, 205 F.3d 1094, 1096 (8th Cir. 2000). To establish deliberate indifference,
a prisoner must prove he had objectively serious medical needs and the official
actually knew of but deliberately disregarded those needs.

Around here they will provide you with a CPAP and replace your supples when you request it (within reason) I have sold several CPAP's and supplies to the prisons here. None of my patients have gotten out so I don't know if they get to keep it when they leave. They do get to take it with them if they are transfered. I have visited their "cells" and they do not have it in a box. I had to be cleared and the machine has to be cleared, but after that it is the same as you and me.

WindFlyer, now that you know you can have one it is still no reason to go through with a Dasterly Plan.

I'm sure I'll be able to tell you once my Doc finds out I broke the law and took an interest in my own treatment...

Taking an interest in your own health treatment is "only" a misdemeanor on the first offense - BUT - changing your therapy pressure is a felony. Three strikes and yer out! Er, IN, prison, for life.

There was a case I read about - in California. A guy on death row needed a transplant, I forget which organ. He was first on the transplant list when the organ became available. Second on the list was a fine upstanding citizen. Guess who got the organ??

There were several court cases filed about this -but in the end the death row guy did get the organ.

Ain't that a crock? The state goes to all that expense for the transplant for a guy who the state is gonna execute - a useful organ goes to waste - and the second person in line might die before another compatible organ becomes available.

I would have like to have done the operation, he would have died during the removal, and we would have still had the organ for the next person. Jim
