I like my Respironics more than my Resmed. I have been using my refurbished Dreamstation for at least a year.

Checks were supposedly going to start going out on August 9th according to some reports.

see my post a few posts ago: Just spoke with the lawsuit customer service, and they said the payments just started going out last week, and will go out in rolling batches, there is no way to track them, and she didn't know when the bulk of them would go out. So if you haven't received anything, it doesn't mean you won't.

I think it is all just a scam. When your check doesn't arrive in the next six to nine months they'll just tell you too bad as we don't have any way to know if your check was ever even sent.

So, I should use a Resmed machine I can't tolerate instead of a Dreamstation I can tolerate? It isn't helping my health if I am up half the night because the way the Resmed operates doesn't work well for me. I bought a Resmed after the Philips recall. I got my refurbished Dreamstation and decided to use it for a trip in my motorhome. I found during that trip that I can tolerate the Dreamstation much better.

Page 18, Section VII. Objections states: "....To be clear, this Settlement is solely for the economic loss related to the Recalled Devices themselves and does not strip the class members of any claim for potential recovery related to personal injury or medical monitoring."

I had a System One CPAP machine that I returned to Philips Respironics in the Recall. I received a refurbished Dreamstation CPAP machine from Philips in exchange.

I received a settlement check dated 8/30/2024 for $168.24 from the Settlement Administrator. I hadn't cashed the check yet pending looking into what this is. Is it okay to deposit this check? Based on Section VII. Objections listed above, it appears that I wouldn't be waiving any rights by depositing this check if I have some kind of personal injury from using the refurbished replacement Dreamstation CPAP--is this a correct interpretation?

Has anyone received a settlement payment recently? I'm wondering if I'll ever get mine or if this was just a big scam to get their faulty devices back?

I emailed the address attached to the original settlement email with my confirmation id and original Respironics serial number and this was their response:
Thank you for contacting the Philips Respironics CPAP Class Action Settlement Administrator.

Claim processing is currently in progress.

Payments for eligible claims began earlier this summer and will continue on a rolling basis. We are unable to provide a date for individual payments.

Device Replacement Awards and Payer Awards will not begin to be distributed until after all claims submitted by the August 9, 2024 deadline have been fully processed. We do not have an estimate on how long this will take. Please be patient.

I received an email from Philips this past week stating that, essentially, they're still waiting for my 'script from my sleep doctor so that they can process my claim and send out my replacement device(s).

Problem with this is, I've long since received my replacement devices, two from my DME (sitting on a shelf, unused in my closet), and returned two devices to my DME. I've spoken with the agents associated with the recall at least three times over the phone and told them the entire story each time, so they're aware but seemingly unaware.

I also purchased my own device out of pocket, and I'm supposed to get some sort of reimbursement from that.

Looks like another phone call is in order.

Just now got off the phone with a Settlement Administrator or three. I had to make three phone calls to three different people before I just now gave completely up on receiving any reimbursements from this BS settlement.

I returned two bipaps that were included in the recall AND I purchased a ResMed bipap out of pocket during the time frame that they are reimbursing folks for their purchases.

I got the run around by all three of these people and I'm giving up, I surrender, they win, and I get nothing.

Screw em!!!

Sent 5 Auto CPAP in got 1 payment still 4 outstanding returned CPAPs and converted them into remanufactured BiPAPs kept the old BiPAPs and removed the disintegrating foam. They knew the problem and hid it as you see the newer designes tried to isolate it.

I am getting the feeling I will get nothing from the settlement too. I will probably send a letter to the court in another month or two stating I never received my payment. I know they have both my correct email and my correct mailing address. They managed to email me about the settlement, and they managed to send me letters about the settlement. I got two emails and two letters since I had two machines that were affected by the recall.
