What's to be angry about? I could care less if Resmed goes to $1000 for a mask because it doesn't affect me to begin with. The fact that I think people should be informed as much as possible I do believe in. I guess you don't agree. Everyone has to make their own decisions based on knowledge they have received concerning a subject. The more they know, the better prepared they are to make the most intelligent decision concerning themselves.
The fact I don't agree with Resmed's tactic and reasoning is my own personal opinion. Somehow, I got an impression most others on this forum were expressing their own opinions also. So, I am doing nothing different. Are you angry that I am not angry? The force doesn't go with the dark side.

Answer to Tejano Regarding Resmed,

I believe that Resmed is in violation of Federal [United States] Law.

Restraint of competition.

Conspiracy to restrain competition.

Vote with your wallet if you choose.

But if you choose.

THE UNITED STATES JUSTICE DEPARTMENT SHOULD BE INFORMED OF THIS.

Look up Pennhurst State School and Hospital vs.Teri Lee Halderman et al on Google if you think the little guy can't win.

If I am not mistaken, in The United States, it is a violation of federal law to restrain competition, it is also a violation of Federal Law to conspire to restrain competition.

The Justice Department should be informed.

I would have been dead or been paralyzed a long time ago if I assumed.

What is the downside of calling and writing your Senator and Congressperson?

I do not think that we are tilting at windmills.

Other people have offered an opinion that Resmed is not in violation of the law.

I am offering an opinion that Resmed is engaging in restraint of competition.

I have a ResMed REMstar m . I just got it two weeks ago. I think resmed thinks that there will not be a market after the DME sale. So they are trying to get what they can on the front end. But this will bite them in the end because with millons with a xpap the machines will die and have to be replaced. I will look at all the brands when I replace mine. Air pumps are cheep to make!!! So one of the other companies will take advantage of this. The DME is also looking at the bottom line!!! If there is not a counter balance by the other compnies them there is a trust which is illegel. The only problem I see is the case of money causing the DOJ to look the other way like in the case of microsoft.

Vader, anger is often an intermittent emotion, useful primarily to provoke action. After one has responded with appropriate effective action, anger tends to quickly dissipate. Sthnreb has acted and seems OK with that. What's to be disingenuous about?

Companies fix a standard price every day.

Try to buy a Tempurpedic mattress.

You will pay the same price in any store you go to.

Period.

However, you can get a store to throw in pillows, mattress covers, maybe some sheets etc. etc. in order to make the deal.

But the reciept with show the standard price Tempurpedic insists on.

ResMed is perfectl legal to do this and perfectly stupid. I don't have to buy ResMed masks to go with my S8.

In fact, I'm breaking in a Hybrid.

Problem is most of their initial customers have no knowledge of the field and what is going on.

Their doctor sends them to a sleep lab and the doctor there prescribes whichever machine is kicking back the most to him.

Only after they get set up do they, maybe, begin to learn.

But I'm sure many people just go with the prescribed treatment and never find out about places like this.

Probably the majority.

All we can do is buy non ResMed replacements.

I think you (Vader) may have misunderstood sthnreb. His point was that most newly diagnosed OSA patients (DME victims) are uneducated about their treatment options. There was no anger nor was he disingenuous about his opinion to educate OSA patients about their options.

Just because you were lucky in your success with PAP treatment does not mean everyone else is.

Where is the restraint on competition??? By refusing to allow their products to be sold at lower prices-they are the ones who could be hurt by their price (I agree with others that it will not cause a significant loss).

Price fixing is illegal-but this is not price fixing which is when manufacturers enter into agreements to set prices on similar products-to force the prices up. If all the manufacurers start instituting price controls-the DoJ might be interested. Microsoft got into problems with bundling product-and there must be other practices that DoJ is interested in but I don't think this is one of them as the potential harm is to themselves. The problem of insurance is a social problem and needs to be solved at that a social level-guess a "higher" level than we have evolved to.

Sorry, Nasty, but you are wrong. The US Supreme Court ruled just this year that minimum price setting by manufacturers is NOT illegal.

Somebody must have lots of time on hand to go back to Sept of 2006 and rekindle old posts. Why not move on? I personally will purchase products of equal or better quality at the lower price. To each his own. If you think you are getting a better product because you pay more for it.....goferit.

Regardless of whether or not one feels this approach could be effective - Congress has a way to get involved if they are so inclined.

However, no one has thought of a potentially more effective way to voice
your opinion,

CONTACT THE STOCK ANALYSTS WHO FOLLOW RESMED - the ones who
ask questions at the quarterly meetings that are posted on the Internet.

If these folks agree and raise the question to ResMed, this goes to their
bottom line - the people who recommend (or not recommend) purchase of
Resmed stock.

Also, don't underestimate the impact of congressmen changing regulations, such that insurance reimbursements are not available under government programs if a company takes a certain action.

This is how the States get "controlled" by the Federal Government to follow
rules such as imposed speed limits or other items. The Federal Government has no authority to impose this on the States - but they make it a requirement to receive highway funds. In effect getting their own way.

I like my ResMed equipment - but I won't pay $4000 for it out of my pocket, if I were forced to do so - at the extreme result of all this -- at least not before exhausing other possbillities - such as trying the competition.
