Thousands of sleep apnea sufferers rely on a lone Australian CPAP hacker to stay healthy

According to this article, Sleepyhead may be in breach of intellectual property laws. Even though the machine manufacturers are profiting from selling proprietary software to read the cards in the machines, it is really in their interest for parients to be able to use Sleepyhead. Here are the reasons:

• A patient who is able to get a his (or her) therapy working well is more likely to be compliant. This means that the patient will more likely meet the compliance requirements and the insurance will pay for the machine. A compliant patient will likely order supplies (mask, headgear, filters, water chambers, etc.), and will live to need a replacement machine. A non-compliant patient will not order supplies or a replacement machine, even if he still has the original machine.
• A larger pool of successful/compliant patients will mean that more friends, coworkers, relatives and acquaintances will seek treatment (many of whom will end up using a CPAP machine).
• It would make CPAP use more feasible in underdeveloped countries. All you need is the machine, access to supplies, access to reliable electricity, access to a desktop or laptop computer, and access to the internet (admittedly, some of these might not always be the case).

Mark is fine under Australian law. Don't know about the US.

Another poorly researched article. Mark is not n the US.

Even if he were in the US he is not bypassing any DRM. He has just legally reverse engineered the data formats which is perfectly legal. No legal exemption for medical devices needed.

As law-abiding residents, we should ALL care on legality.

My point is that it was perfectly legal for Mark to make SleepyHead, much like the software Samba developed by reverse engineering on the network. Samba became so good, Microsoft used it as a reference for how their software actually works.
