Where do I sell a cpap? Ebay? Is it legal??

I am moving in a few weeks, and I have a cpap from two years ago, that I don't want to ship. It's been in the closet for two years now! Anyways, is it legal to sell a used cpap? And if so, do I go through ebay or is there a better site? It's mine, as the insurance company rented it for 9 months from the DME, at high markup, so on the 10th month, it became my property.

You defiantly can't sell it on ebay they will pull your add real fast! You can sell it on our companion site, CPAPAuction.com

Since you've already started this thread about it, you might want to make another post and list all of what you want to sell, in case one or some of the members wish to contact you and purchase it from you. Frequently, some people are looking for an additional machine or don't have a prescription and wish to purchase from someone they feel like they "know". That's how I bought my first APAP/Auto. One of the members made a post offering to sell it.......and I jumped at the opportunity.

Selling on cpapauction.com is perfectly legal because they verify that bidders have a prescription... ebay does not have a system to verify prescriptions, so they don't allow the items to be sold. I don't know about the legality of selling person-to-person without verifying prescription, so if you want to make sure your transaction is on the up-and-up, cpapauction is the way to go.

The legality of selling a prescription item would depend on the laws of your state.

However, the odds of being caught are slim. The odds of being prosecuted on first offense even slimmer.

As already covered there really are only 3 options & 1 is not really necessary.

1) Cpapauction.com

2) Is Craigslist (but less reliable)

3) Is to try to sell here but this is the questionable option because cpaptalk set up cpapauction just so people could sell machines without hijacking the purpose of cpaptalk.

eBay enforce that no cpap sale in other countries even though local laws are not being violated.

Thank you for your replies. My feeling is that Craiglist may be "breaking the law" in some states, but in some ways, if it is a poor person's only option to get treatment and an "experienced" cpap user shows them how to change pressures, talks to them, etc. then, it's all right morally with me. Access to medical care is so limited right now, and the high co-payments, especially for sleep studies, doctors that really don't do anything, etc., isn't always the best for the person. Sleep apnea treatment through the regular channels is not cheap! In some ways too, this may be too much government intervention in our lives (no, I am not a tea-bagger by any means!). It's a piece of medical equipment, not a narcotic. People let other people borrow crutches or canes all the time. They could be harming themselves with the crutches or canes, or they could benefit greatly from them. . Yes, there is some risk of harm with not having a prescription for cpap, but for someone with no other option, it could be life saving.

Sorry, I forgot. It's a Respironics Remstar Plus with C-Flex, a Fisher & Paykel Flexifit full face mask, and a 6 ft. hose. I want about $175 for all of it...shipping sort of depends on what the person wants. I actually used it quite a bit ..I am very compliant with my cpap treatment, and I think for about 11 months. Oh, and I don't smoke and live alone. Many of those ads I have seen, say that it was used only a couple of times, so I may have to lower my price. I have started looking locally first for a buyer--thinking I can help with knowing the machine more than those who used a few times. But in a few days, I will probably put it up on cpapauction. I see that a few have mentioned just posting this here,, so here goes. I will try Craig's list too. I have an almost new RESMED s-9 ESCAPE with all accessories two masks, case, Heated humidifier . all paperwork, EVERYTHING> I'd like to sell it. looking for a reasonable offer. It's in mint condition. It cost me $1200. but I've willing to let it sell for much less.
