Does the government require a prescription for a CPAP machine because a CPAP is considered a drug of abuse? If I buy a used machine without a prescription have either the seller or I broken the law? How many years will I be in prison if I am caught?

The seller of a new machine requires a prescription to sell it but is the only one on the hook if they don't get one.

How much trouble is the seller in? If I buy from him or her knowing I do not have a prescription have I entered into a conspiracy, as defined in the Federal RICO? If so how much prison time do I face?

Many laws exist, but are not enforced; because to do so is just plain SILLY.

NONE!!!
It's NOT illegal for individuals to buy and sell these devices.
For all intents and purposes, the only entity which has to require a prescription is the one selling new devices, or "dealers" which have to comply with FDA rules.

Place a bunch of burning pot in the intake portal of the machine, put the machine on, put on your mask, and have sweet dreams

Just may be me, but somehow I don't think this would be suggested by a doctor or any member of the forum. Did you do this? How did it go?

If you use it without a prescription, not knowing the proper settings to use, it can cause all kinds of trouble. Health trouble, not legal...

I think lastlib is just having fun with a silly law/silly idea.
I do believe that buying a used machine without INSPECTING it is a bad idea.
. . . especially checking the smell--both inert and running.
Possession of mj might be determined from smoke residue inside.
