Respironics BiPAP + humidifier - can I sell it?

Post by JohnnyABQ » Wed Sep 17, 2014 8:17 am

Hi there forum!

I have a quick 'legal' question for you guys.

Recently, I was given a BiPAP machine by a friend. Since I don't have a use for it, I was wondering if it's legal for me to sell it? It's a brand
new unit and had never been out of the carrier except for just now when I had to find the model name and number.

I don't know much about these but I did find out it was a:

Philips Respironics BiPAP PRO 650P Bi-Flex
Remstar heated humidifier attachment
Respironics mask & tube
Power cord
Carrying bag

If anybody could give me a hint or advice, it would be much appreciated.

Regards, John

Don't know about legal question, but wondering what you were thinking of asking for the machine.

Why did your friend "give" you the machine?
Is your friend supposed to be using it?
If your friend's insurance is in the process of paying for the machine, then it's NOT LEGAL for you to possess it, let alone sell it.

Something about this "deal" stinks to me.

Edit: And, to get nitpicky about it, those are "prescription" items. Do YOU have a prescription for it?
If it's not yours and you don't have a prescription for it......the CPAP police could be knocking on your door at any time.

If you want to sell it, you will need to post a picture of the front of the machine, showing total hours on the machine. Also post a price & method of payment, if you are charging for shipping, how much AND most of all, why we should trust you, since you just joined the forum today.

Personally, I'm not inclined to trust you because of the 'legal' part of your question and the fact that your friend 'gave' you the machine & you are selling it. Why didn't your friend sell it?

Sorry, but I doubt you'll find any takers here. You might try Craigslist, but if you don't have a legal RX in your possession, you could be considered to be selling stolen medical equipment.

Thanks for the answers all.

Maybe I was a little unclear from the getgo here. The legal part of my question was; can I as a private party sell something like this and
where do I go to do that.

The machine was originally purchased for my friends' father. He got together with some other relatives and bought it in-store in order to give it to his dad.
Unfortunately, he passed away before he could even use it.

Like Jen said, maybe this forum isn't the right venue but since I'm not keeping it, I thought I should ask.

If anybody is interested, I have no problem shipping it to any trusted member, before any payment is made, for them to look it over.
