Does the government require a prescription for a CPAP machine because a CPAP is considered a drug of abuse?

Yes, because they're regulated by the FDA.

If I buy a used machine without a prescription have either the seller or I broken the law?

No.

How many years will I be in prison if I am caught?

Zero.

Sheriff,

I can assure you that you would NEVER find any illegal drugs. Never tried them, never would......and I'll try not to get into describing what I think of those who DO use or (especially) sell them.......use your imagination.
I've seen what they do to people (especially kids) and I hope there's a special place in Hell for the dealers.
I guess that gives you a clue how I feel about legalizing that stuff in the U.S.
And, "grass" or "weed" is just a smidgen of the garbage that some of these evil people are getting these kids hooked on or are cooking up in their labs.

Happy New Year and have a good day.......
