Note.....I have never lost a post/reply with this error. I just keep hitting "resend" and it finally takes and I check to make sure. Hasn't happened often that I have had to do that.

At the time of the original posting, no verdict had been returned yet. Since then, he's been found guilty so it's no longer hypothetical.
A judge (or a probation officer empowered by the court) can compel medical tests upon conviction for various reasons. For instance, (1) they don't want to incarcerate somebody who cannot medically tolerate incarceration, (2) they want to know if he has a drug problem, (3) they want to know if he's mentally ill, and many other reasons.

A sleep study is likely warranted if a person falls asleep while driving and causing an accident. Easy to reach that conclusion on the part of the judge. But, they're not doctors and lack the training to make diagnoses and order tests. I don't believe he will be incarcerated, but there was a character in the first season of Orange is the new Black who supposedly had a CPAP machine. Although the prop people didn't do their homework, and it was an oxygen concentrator instead (which, incidentally, are REALLY noisy!!!).
