Monopoly?

Post by ozij » Tue Aug 30, 2005 6:34 am

I've just read the following on TAS:
ResMed and other manufacturers are now prohibiting us from selling their equipment outside of the United States. This applies to all online sellers as well as walk in retail stores.
Is that true, Johnny?

The thread was titled "seeing red" for a different reason, but I am seeing deep red.

O.

Unless this is a change from when cpap.com made their FAQ:

https://www.cpap.com/cpap-faq/International.html#125

Will you ship to my country?

Yes. We will ship to any country in the world with the exception of the following countries:

* Cuba
* Iran
* Syria
* North Korea

Back to Question Back to Top Ask A Question
How much are the taxes and duties of shipping to my country? Who pays?

The buyer is responsible for determining, managing and paying all taxes and duties associated with our transaction. We will not pay and can not quote taxes and duties. However, we can work with you to package and properly label international shipments as medical supplies.

Back to Question Back to Top Ask A Question
Will you accept a prescription from a doctor in my country?

Yes.

If you and your doctor are residents of the same country and the prescription given to you meets the guidelines set down by your country, we will accept your prescription.

Greetings,

I can not speak for other dealers. cpap.com is currently shipping internationally as per our FAQ. I can't comment past that at this time. Please expect more information to be released at a later time as it becomes available.

Thanks,
Johnny

ozij, I saw that thread and also on the thread from TAS

This applies to all online sellers as well as walk in retail stores.

If other online retailers are shipping to Canada, they are breaking the rules. Here at TAS, we play by the rules.

Whose rules are they? I cannot believe ResMed would not want to sell to Canada.........this does not make since to me

This is sounding sort of a gray market issue in which the the regional office handles the selling and the warranty claims but I do not have the full story. However there is still discount places in Canada in which I brought the ResLink. On second reading this sounds more like distributor issue.

I hope everyone closely follows what ResMed and other medical device suppliers are doing to restrict and control their products. I think this also applies to the major drug companies too!

I think that what is being reported could be correct about ResMed's international shipping policies. It will only be a matter of time until ResMed tries to take action to enforce their policy, as it is not a governmental policy.

My original DME here in Calgary, Alberta, used to stock ResMed masks. My respiratory therapist personally thought the Ultra Mirage was one of the best masks available for his patients. On his own, he developed a small stock of masks, headgear and many replaceable parts, so he could provide his patients with any support they might need. After providing this service for a few years ResMed served him and the company with a stop and desist order. This was done so that the DME that ResMed selected as their sole representative was protected. For a while anyone that needed Ultra Mirage parts from my DME got them for free, as they could not legally be sold.

In Ontario, VitalAire holds the sole rights for selling ResMed machines. Their prices are nothing short of usurious --I was charged over $100. to rent a Spirit for a week's trial. This was a big part of the reason that I did not select the Spirit for purchase -did not want to have anything to do with VitalAire.

For ResMed to get rigid about policy would come as no surprise to me.

Sounds like the pressure put on machine/mask manufacturers
by the large "bricks and mortar" DME chain stores
is starting to pay off...for those DMEs.

Oh dear...I certainly hope that doesn't happen. I don't know about other countries, but lots of Australian SA patients buy their machines and equipment from the USA because even with the shipping cost it winds up 30% - 50% cheaper! Which is a huge saving with or without private health insurance. Even if you have to send it back for a repair or two you still come out ahead.
