It's amazing that any Dr. would have a form like that on hand. Says a lot about their attitude. IMO. I would talk to the Dr. himself. He may not know he has an abusive staff that's costing him business.

I would retain an attorney to procure your Rx in an official capacity, by doing so, he/she will be alerting the Dr.'s office that they're violating a law. I'd also see what's involved in filing a complaint with whatever board is applicable in your state. Doctors really hate when actions are brought against them. Usually, their God complex makes them forget that their lowly patients do have recourse at times. There are also some doctor "report card" review sites online, you might post your assessment of them on one of these sites, just be careful with wording......... so that you aren't sued for libel, etc. I hope you're able to serve them a serious wake-up call ! This entire situation is over the moon. Personally, I wouldn't wait to file a complaint(s) and I would send copies of everything to the doctor, certified/proof of delivery, so that he knows quickly what you've done. That doctor did you a big favor! I'm sure there are doctors in your area who are competent.

No idea why you would tell the Dr's office that you plan on using your RX anywhere? You should already have a copy of it and your sleep study. If not, they are required under law to provide it to you.

BTW, You don't ever need to tell them when you are using an RX they have created. We are not talking about Narcotics here... If you want to use Cpap.com, you just use their form to supply your copy (even an older copy)

BTW any Dr can write an RX for masks.

Looks like the Dr. wanted to upset you and it worked!

I told my doctor I was no longer taking his statins. He got real angry and told me I would be dead before Christmas. He insisted I would die very soon. This was September 2014. I just sat there and watched him go on and on. Finally I asked if the interview was over. He confirmed that it was. I told him I would hit his father with a rock when I got to the other side (his father passed a few years ago). Saw him since and told him I wanted something for a mild ear infection. No problem. I told the nurse at the clinic that I did not want my blood pressure taken. She asked why. I told her that if one is not careful "you can easily end up with a prescription around here".

The office manager told me I could not have a copy of the prescription, that she would send it to med tix only....

thanks for all your replies. I will def go to the new dr's office this week to sign a release to get my records, as i was told it could only be sent to a dr not released to me - atleast thats what this form says. Yea right i never thought about how they have such a paper on hand lol were alls they do is fill out the patient name, circle the reason and have the dr sign

YOU own your medical record and the doctor is required by federal law to give it to you upon written request (except under certain circumstances that do not apply here). Request your ENTIRE medical record in writing sent by certified mail as suggested. Beware that they can charge you for making copies. But then you will be able to see if they documented the so-called "incident" (very likely) and you can decide how you want to proceed.

No matter what they say on a piece of paper, YOU are entitled to your records which includes a copy of your RX and sleep study. That's the law.

Be sure to send a certified letter, and mention HIPAA.

Unfortunately, they don't have to issue you a new prescription. They might have had to give you a copy of your prescription at the time they issued the first one, but they can now claim that the original prescription has expired. They might or might not have to give you a copy of your original prescription, but they can probably mark it as "expired."

There's also the trick that they can claim it isn't a "prescription," it's an "order," which may have slightly different rules.

That's what I think. I've never been denied my own records.

completely agree with this. I personally would walk in to the office to ask for the copy,. its a lot harder to refuse me in person and especially if im being nice. if they still refuse, everyone in the office would know what happened and id bet they dont want that. in the end you are the customer, you paid for it, you deserve to get it.

Totally agree with HeartJumping.

My sleep doc is in bed with the DME as well. It's not easy. When I went rogue and got my cpap from cpap.com instead of his selected DME, I didn't receive a call for a follow-up appointment at the 30-day and 90-day marks as usually done... I had to call him to ask what was up. The office staff said words to the effect of, "Oops, since you're not working with our DME I guess you fell through the cracks." No "sorry," no nothing.

Sadly my sleep doc's practice is the only one within 50 miles or I would change tomorrow.
